EXHIBIT B <br />DRAFT CONDITIONS OF APPROVAL <br />PADR-1698, Scott and Laurie Smith <br />3496 Whitehall Court <br />March 4, 2008 <br />The proposed development covered by this approval shall conform substantially to <br />Exhibit A, dated "Received, April 27, 2007," on file with the Planning Department, <br />except as modified by the following conditions of approval. Minor changes to the <br />proposal may be approved by the Planning Director if found to be in substantial <br />compliance with the proposal. <br />2. This design approval shall lapse and shall be void sixty (60) days following the <br />effective date of project approval unless prior to the expiration of 60 days, a building <br />permit for the additions totaling 337 square feet per PADR-1698 is issued. <br />3. No design review approval or building permits shall be extended. Should the design <br />review approval or building permit lapse, the additions shall be removed/demolished <br />by the owner; or a new design review application will be required to be submitted to <br />the City. <br />4. If Conditions No. 2 and 3 are not satisfied, staff shall initiate nuisance <br />abatement process per Section 9.28 (Property Maintenance) of the Pleasanton <br />Municipal Code. <br />5. Within six months from the date the building permit is issued, the applicant shall <br />obtain a building final and complete all exterior and interior work related to PADR- <br />422 (2001 project) and PADR-1698, including but not limited to all plumbing, <br />electrical, swimming pool, landscaping and irrigation, and all flat work. A final <br />inspection by the Planning Department is required prior to the final inspection by the <br />Building and Safety Division. <br />6. All site improvements and construction activities shall be limited to the hours of <br />8:00 a.m. to 5:00 p.m., Monday through Saturday. In addition, no construction shall <br />be allowed on Federal Holidays. If complaints are received regarding the Saturday <br />construction hours, the Planning Director may modify or revoke the Saturday <br />construction hours. The Planning Director may allow earlier "start-times" for specific <br />construction activities (e.g., concrete-foundation/floor pouring), if it can be <br />demonstrated to the satisfaction of the Planning Director that the construction noise <br />and construction traffic noise will not affect nearby residents. All construction <br />equipment must meet DMV noise standards and shall be equipped with muffling <br />devices. <br />7. The window(s) facing the Morgan's shall be non-reflective glass. This requirement <br />shall be stated in the construction drawings submitted for plan check and building <br />permit. <br />Page - 1 <br />
