THE CITY OF
m~n.,~ Int
1
j~L~E~S~4NTON®
March 4, 2008
Planning and Community Development
TITLE: PAP-110 (PAP-108/PADR-1698), DENNIS LONG, ROBERT LEETE AND
FRANK MORGAN, JR., APPELLANTS; SCOTT AND LAURIE SMITH,
APPLICANTS - CONSIDER AN APPEAL OF THE PLANNING
COMMISSION'S APPROVAL OF AN APPLICATION FOR AN
ADMINSTRATIVE DESIGN REVIEW APPROVAL FOR THE
CONSTRUCTION OF AN APPROXIMATELY 64-SQUARE-FOOT
SINGLE-STORY ADDITION ON THE LEFT SIDE AND AN
APPROXIMATELY 273-SQUARE-FOOT SECOND-STORY ADDITION
ON THE RIGHT SIDE OF THE EXISTING TWO-STORY RESIDENCE
LOCATED AT 3496 WHITEHALL COURT.
PROPERTY OWNER/ Scott and Laurie Smith
APPLICANTS:
APPELLANTS: Dennis Long, Robert Leete, Frank Morgan, Jr.
GENERAL PLAN: Medium Density Residential - 2 to 8 Dwelling Units Per
Gross Acre
ZONING: R-1-6,500 (Single Family Residential, Minimum Lot Size
6,500 square feet) District
SUMMARY
At issue is whether the proposed addition, started without prior approval or permit and
now near completion, should be allowed. The addition is an expansion of a previously
approved, currently under-construction addition at the Smith's. The applicants changed
the scope of the previously approved project during construction. Three neighbors
indicated that the overall addition is too large for the neighborhood, the duration of the
construction has lasted longer than anticipated, and that the portion of the additions that
were not approved or permitted should therefore be removed. The addition in question
has been constructed as an integral part of the residence, and it meets the
requirements (i.e. setbacks, Floor Area Ratio, and height) of the R-1-65,000 zoning
district. The Zoning Administrator and later the Planning Commission approved the
application. The neighbors have appealed the Planning Commission's approval to the
City Council.
14
CITY COUNCIL AGENDA REPORT
