ASSOCIATED <br />~ RIGHT OF WAY <br />SERVICES, WC. <br />3. AR/WS will prepare acquisition documents for the property proposed to be acquired. All <br />acquisition documents to receive Client's written approval as to form prior to use by AR/WS. If <br />agreement with the property owner cannot be reached, ARNVS will advise Client that <br />negotiations have reached an impasse. <br />4. It is not anticipated that the City will pursue condemnation of the property. Therefore <br />condemnation support is not included in this scope of work or our budget. <br />If settlement with owner pursuant to the Client approved appraisal or Client approved <br />administrative settlement, ARIVIIS will prepare a Memorandum of Settlement for transmittal to <br />Client. If an administrative settlement appears to be prudent, ARNVS will prepare a settlement <br />discussion memorandum reviewing the issues. This memorandum will require Client written <br />approval before implementation of any settlement agreement. ARJWS will establish with Client <br />a process of coordinating escrow closings and reviewing escrow instructions. Where there are <br />escrow closings, preparation of escrow instructions will be completed by title company. <br />Approval of conditions of title and escrow instructions, including but not limited to, "subject to" <br />title exceptions, will be done by Client. <br />Client Obli~tations tAcguisitionl <br />1. Written approval of all acquisition documents in a timely manner. <br />2. Direction as to administrative settlements, negotiating authority and condition of title <br />acceptance. <br />3. Providing any formats to be used by AR/WS on Client's behalf. <br />4. Selection of title company. <br />5. Review and approval of title company prepared escrow instructions including acceptable <br />condition of title. <br />C. Project Management -General Consultation <br />1. The AR/WS project manager will establish work process with Client and manage and coordinate <br />the real estate functions. <br />2. The project manager will provided on-going consultation and perform recurring project <br />management duties. <br />Our scope of work includes attendance at up to 6 project related meetings including meetings <br />related to ARNVS Negotiation) Acquisition and Project Management-General Consultation <br />services. If additional meetings are requested additional budget may be required. <br />4. The project manager will provide assistance with analyzing various courses of action. Work <br />with Client to resolve problems and recommend solutions. <br />
