Commissioner Pearce believed that had already occurred and preferred to wait until the
information is available because of the already impacted calendar. She believed that would yield
a more productive workshop.

Ms. Decker suggested that the Commission request staff to provide the Commission, within the
next 30 days, with the background information, the previous Code amendment, a transcript of the
hearing, and the issues discussed at that time. She believed that would refresh the
Commissioners’ memories and indicated that the packet would also include additional
documentation.

Commissioner Blank moved to request the background information and supporting
documents from staff within the next 30 days, as detailed by Ms. Decker.
Commissioner Narum seconded the motion.

Commissioner O’Connor believed that additional input should be available so a prepared Code
amendment would not omit future concerns about basketball hoops.

Chairperson Fox noted that some cities have regulations regarding flagpoles and other poles in
yard and suggested that the second workshop address those regulations as well.

ROLL CALL VOTE:

AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce.
NOES: None.
ABSTAIN: None.
RECUSED: None.
ABSENT: None.

The motion passed.

4. REVISIONS AND OMISSIONS TO THE AGENDA

Ms. Decker advised that Item 5.a., PAUP-4, Jennifer Hosterman, has been continued by staff.
She noted that the item had been noticed incorrectly; the staff report identified the zoning as
PUD-MDR, which was correct, and that the notice that was published in the newspaper and
distributed to surrounding neighborhoods reflected the zoning as R-1-6,500 (Single-Family
Residential) District. This item would be renoticed for the next available date. She added that
staff had received comments from neighbors who had questions and concerns. Ms. Decker noted
that staff required additional time to discuss these concerns.

In response to an inquiry by Commissioner O’Connor regarding whether the subject
neighborhood was governed by CC&R’s, Ms. Decker replied that she was not sure. She added,
however, that it was a PUD with guidelines that are in effect.

In response to an inquiry by Commissioner O’Connor regarding whether the Commission should
have a copy of the CC&R’s, Ms. Decker replied that the City does not enforce CC&R’s.
