Planning Director, Jerry Iserson, had written a memo to staff providing a Zoning Ordinance <br />interpretation, which reads: <br /> <br /> “Subject: Zoning interpretation regarding residential basketball hoops and backboards. <br />Basketball hoops and backboards on residential lots, even those over ten feet in height, <br />will not be subject to design review and will not be treated as accessory structures in <br />terms of setbacks or yard requirement. Thus, there are no zoning requirements for them.” <br /> <br />He expressed concern about 13-foot high basketball hoops with full-size backboards which he <br />did not believe met the original spirit of the Code. He noted that they cast shadows on <br />neighboring yards and made a great deal of noise. He requested that until the Planning <br />Commission received a recommendation from Planning staff, the document be revoked until <br />either an ordinance is developed that either supported the document and is approved by the <br />Planning Commission or an alternative is developed and approved. He believed the backboards <br />and hoops were much more invasive than a swimming pool. He was very concerned about <br />neighbors who did not respect the rights of their neighbors. <br /> <br />Chairperson Fox inquired whether Matters Initiated by Commission Members could be opened <br />in order to clarify this issue with respect to the December 2006 meeting. Ms. Harryman <br />responded that the Commission may only provide a brief response because this was not an <br />agendized item. For further discussion on this item, the Commission should request that it be <br />agendized for a future meeting. <br /> <br />Commissioner Olson moved to open Matters Initiated. <br />Commissioner Blank seconded the motion. <br /> <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: Commissioners Blank, Fox, Narum, Olson, and Pearce. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: None. <br /> <br />The motion passed. <br /> <br /> <br />7.
