BACKGROUND <br />On November 6, 2007, the City Council adopted Ordinance No. 1961, approving the <br />application of the application of James Tong, Charter Properties (Oak Grove <br />Development) for PUD plan approval, as filed under Case PUD-33. This project would <br />create 51 custom home sites and designate the remaining area for permanent open <br />space, on a 562-acre site located at 1400 Hearst Drive, near the present terminus of <br />Hearst Drive, to the south of the Vintage Hills and Grey Eagle Estates, and to the east of <br />Kottinger Ranch. <br />On December 5, 2007, within 30 days from the date of adoption of the Ordinance, the <br />proponents of the referendum submitted to the City Clerk 191 sections of a petition <br />containing 5,225 signatures, by prima facie count. At the conclusion of the prima facie <br />count, the City Clerk delivered the petition to the County Registrar of Voters (ROV) and <br />requested signature verification. <br />By facsimile, on January 11, 2007, the City received from the Registrar of Voters the <br />attached Certificate of Petition. The ROV determined that the petition contained 408 <br />valid signatures of qualified registered voters in the City of Pleasanton based on the <br />random sample examination set forth in section 9115 and the formula prescribed by the <br />California Secretary of State, and that this number represents 115% of the total number <br />of signatures needed to qualify the referendum. <br />As prescribed in sections 9114 and 9240 of the Elections Code, if the petition is found <br />sufficient, the elections official shall certify the results of the examination to the city <br />council at the next regular meeting of the council. <br />Submitted y: , <br />Ka en Diaz <br />City Clerk <br />Legal Review: <br />'~ ~~ ~'~ ''11 C~..r'~G~~ <br />Michael H.
