At the suggestion of Officer Ficken, the applicants planted vegetation around the <br />pen to muffle the minimal noises that the chickens did generate. <br />PUBLIC NOTICE <br />Staff sent notices of the Planning Commission's public hearing on this item to all prop- <br />erty owners and residents located within 1,000-feet of the subject property on June 10, <br />2005. Staff received comments from several neighbors both in support and in opposition <br />to this project. Comments and related correspondence, if any, is provided in Attachment <br />C. <br />FINDINGS <br />The Planning Commission needs to make the following use permit findings prior to ap- <br />proving fowl in asingle-family residential district. These findings must relate to the spe- <br />cific proposal being made. <br />1. The location of the proposed conditional use is in accordance with the objectives of <br />the Zoning ordinance and the purpose of the district in which the site is located. <br />The subject site is located in the R- l -6500 Single Family Residential District. The <br />keeping of fowl is a conditionally permitted use in the R-1 District. The applicant's <br />keeping of chickens is clearly incidental to the use of the property as asingle-family <br />residence. This finding can therefore be made. <br />1. The proposed location of the conditional use and the conditions under which the <br />conditional uses would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or im- <br />provements in the vicinity. <br />Based on site visits by staff members of both the Animal Control (PPD) and Planning <br />Departments, it is found that both the chicken coop and chickens located at the subject <br />property are well maintained. This finding can therefore be made. <br />.i. The proposed conditional use will comply with each of the applicable provisions of <br />Chapter 18.124 of the Pleasanton Municipal Code. <br />The proposed conditional use will comply with all applicable sections of Chapter <br />15.124 of the Pleasanton Municipal C'ocie and meets all applicable standards. This <br />finding can therefore be made. <br />ENVIRONMENTAL ASSESS~~IEN't <br />This project is categorically exempt from environmental review pursuant to the Calif~r- <br />nia Environmental Quality Act (CEQA) Section 1 X303.
