Aerial View of Su <br />ANALYSIS <br />Permitting Process <br />Federal and state Permits: <br />Falconry is legal in the United States provided that the falconer receives the required <br />federal and state licenses to practice the sport and to keep birds. In order to receive her <br />apprentice license, the applicant was required to pass a written test, have her equipment, <br />outdoor area, and mew facilities inspected, and is required to serve a minimum of two <br />years as an apprentice under a licensed Master Falconer. There are three classes of <br />falconry license, which is a permit issued jointly by the falconer's state of residence and <br />the federal government. Therefore the applicant's Apprentice License will develop into a <br />General Class License and after a minimum of 5 years the applicant may apply for her <br />Master Class license. Those who hold falconry permits are required to renew their <br />license with the State every year; specifically in March. Please see Exhibit D for <br />previous falconry licenses. <br />City Permit: <br />Staff has assessed the requirements for an animal use permit to keep fowl as outlined in <br />the Pleasanton Municipal Code (PMC). The PUD follows the regulations of the single- <br />family residential (R-1) district; which classifies the keeping of fowl as a conditionally <br />permitted use. An animal use permit can be approved provided the use is consistent with <br />the provisions of Section 7.36- Miscellaneous Animal Regulations of the PMC; as <br />directed by PMC § 18.32.040(K); and if the conditional use application meets the required <br />findings of the PMC § 18.124. The Code prohibits the keeping or maintenance of any <br />animals in such manner, number or kind as to cause damage or hazard to persons or <br />property in the vicinity or to generate offensive noise, dust or odor.
