to the public health, safety, or welfare, or materially injurious to the <br />properties or improvements in the vicinity. <br />Staff believes that the keeping of the hawk, as conditioned, would not be detrimental to <br />the public health, safety, or welfare, or materially injurious to properties or improvements <br />in the vicinity. The applicant has received all applicable permits from State andlor <br />Federal agencies and would be required to receive all appropriate City permits. The <br />hawk will not be released, whether for hunting or exercise purposes, within the <br />neighborhood or public park areas. T'he applicant will only release and train the hawk in <br />designated areas. Both the hawk mew and the subject property are well maintained. <br />Therefore, staff does not believe that the keeping of the hawk would be disruptive to <br />adjacent neighbors or the City. <br />For the reasons stated above, staff believes this finding can be made. <br />3. The proposed conditional use will comply with each of the applicable <br />provisions of Chapter 18.124 of the Pleasanton Municipal Code. <br />The proposed conditional use will comply with all applicable sections of Chapter 18.124 <br />and Chapter 7.36 of the Pleasanton Municipal Code and meets all applicable standards. <br />Staff feels that the recommended conditions of approval will help to integrate the keeping <br />of the hawk without detrimentally affecting the surrounding properties and the City in <br />general. As with any use permit, this use can be suspended or revoked if the conditions <br />are not met. As conditioned, the keeping of the hawk would comply with all applicable <br />provisions of the Zoning Ordinance. Therefore, staff believes this finding can be made. <br />ENVIRONMENTAL ASSESSMENT <br />Pursuant to the California Environmental Quality Act (CEQA) Section 15061(b) (3), this <br />activity is covered by the general rule that CEQA applies only to projects that have the <br />potential for causing a significant effect on the environment. Staff fords that there is no <br />possibility that the activity in question will have a significant effect on the environment. <br />Therefore, this activity is not subject to CEQA and no environmental document <br />accompanies this report. <br />CONCLUSION <br />The City of Pleasanton requires an animal use permit for the keeping of fowl in single- <br />family residential districts provided the keeping or maintenance of the animals is done in <br />such manner, number or kind that does not cause damage or hazard to persons or property <br />in the vicinity or to generate offensive noise, dust or odor.
