and exaggerated for effect. Mr. Rodgers feels that raptors are trained to respond <br />to commands, kill naturally, and eat their prey to survive. He believes that the <br />applicants efforts to help an injured bird and release the bird back into the wild is <br />more of a public service than a threat to society. Mr. Rodgers concluded by <br />saying that he witnessed a large hawk sitting in a tree in his neighbors yard eating <br />a bird that it had caught, therefore, he doesn't feel that the applicants actions are <br />going to result in anything happening that isn't already occurring naturally. <br />Eugene Franck, of 743 Montevino Drive, contacted staff via a-mail in support of <br />the applicant's request. Mr. Franck's stated that his property backs up to the <br />applicant's property and he has only heard the bird once since it has been kept <br />there. He continued by saying that he had no problem with the application and <br />believes that this `fuss " is being `politically generated ". <br />Planning Commissioner Request <br />Chair Fox requested that the Commissioners receive copies of the definition of a "fowl" <br />from any City PUD's and Specific Plans. Therefore, Exhibit J includes the information <br />that was requested. <br />FINDINGS <br />The Planning Commission needs to make the following findings prior to approving a use <br />permit. These findings must relate to the specific proposal being made. <br />1. The location of the proposed conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the <br />site is located. <br />Objectives of the Zoning Ordinance include: fostering a harmonious, convenient, <br />workable relationship among land uses; protecting existing land use from inharmonious <br />influences and harmful intrusions; and ensuring that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. In the past, the City has allowed similar animal keeping, such as hens, to be <br />located in residential areas. Staff does not feel that the hawk would be disruptive to the <br />neighboring residences. The subject site is located in a PUD, however adheres to the R-1 <br />District standards. The keeping of hawk is a conditionally permitted use in the R-1 <br />District. The applicant's keeping of hawk is incidental to the use of the property as a <br />single-family residence. This finding can therefore be made. <br />2.
