BACKGROUND <br />Tract 7385, Avignon South, is a 28 lot, single-family residential subdivision located <br />between Old Vineyard Avenue and the realigned Vineyard Avenue adjacent to Fire <br />Station No. 5. This subdivision is located within the Vineyard Avenue Corridor Specific <br />Plan Area. <br />In addition to 28 single-family lots, Tract 7385 also created two vineyard estate lots and <br />2.22 acres of open space. Agricultural easements covering the non-building envelope of <br />the vineyard estate lots are under the South Livermore Land Trust. The owners of the <br />vineyard estates will be responsible for the maintenance of the vineyards. <br />Improvements <br />The streets within this development are public and will be maintained by the City. The <br />storm drain, sanitary sewer and water systems within the public streets will be <br />maintained and operated by the City. <br />The open space within this development will be maintained by the homeowners' <br />association (HOA). The landscaping and irrigation within this development, other than <br />private landscaping on individual lots, will be maintained by the HOA. This includes <br />landscaping along Vineyard Avenue and along the proposed Vineyard Trail. Street <br />trees and entry monuments will also be maintained by the HOA. <br />DISCUSSION <br />All public improvements required of the development have been substantially completed <br />excepting the bulb portion of Machado Court. The City directed Centex not to complete <br />the closure of Machado Court until a final decision has been made whether to close <br />Machado Court or to keep Machado open for local traffic. Discussion of this issue has <br />been tentatively scheduled for the February 18th Planning Commission meeting. At this <br />time, Centex has posted a security bond to cover the cost to complete the closure, if <br />necessary, of Machado Court. <br />City Council will be accepting for formal maintenance the public improvements as <br />described above, and the developer has posted the required one-year warranty bond. <br />Submitted by: <br /> <br />Rob Wilson <br />Public Works Director <br />Fiscal Review: <br />,~ <br />David P.
