BACKGROUND <br />One of the key elements of the Vineyard Avenue Corridor Specific Plan was to realign <br />Vineyard Avenue along the Arroyo del Valle. Construction of this realigned roadway is <br />complete and is currently in use. The former (Old) Vineyard Avenue will become a <br />multi-use trail for pedestrians, bicyclists, and equestrians. <br />As a result of the Vineyard Avenue realignment, a portion of Old Vineyard Avenue is <br />surplus roadway right-of-way. This surplus right-of-way, measuring approximately <br />26,250 square feet (see attachment, vicinity map), is located between Machado Court <br />and new Vineyard Avenue, just east of Fire Station No. 5. <br />Vineyard Avenue, including this surplus portion, has existing city utilities and other <br />utilities owned by PG&E, Pacific Bell, and Zone 7 Water Agency. Abandonment of the <br />right-of-way will not affect any existing easements currently in place. <br />DISCUSSION <br />This area is currently being used as a construction staging area for the City's contractor <br />constructing the Vineyard Avenue Pump Station. Prior to the City recording an <br />abandonment of the roadway, the City will require aright-of-entry from Centex Homes <br />while our contractor is utilizing this property as a construction staging area. In the event <br />that Centex Homes sells this parcel along with lot 30 of Avignon, our contractor for the <br />Vineyard Avenue Pump Station would be allowed to continue use of this site for the <br />term of his contract. <br />Once the contractor vacates this area, Centex Homes will remove the road base rock, <br />and clean and prep this area for landscaping. Due to the existing utilities, the location <br />and type of landscaping will require City review and approval. <br />The City has no further need for this right-of-way and it can be declared surplus. The <br />City would then abandon its interest in both the original 50-foot wide right-of-way <br />(owned by Centex Homes) along with the 18-foot wide strip dedicated as part of the <br />Ruby Hill development (now owned by the Mitchell Katz Winery). <br />Submitted by: <br />~~~.,,~ <br />Rob Wilson <br />Public Works Director <br />Fiscal Review: <br />David P.
