Brian• Swift <br />July 23, 2004 <br />.Page 2. <br />The outcome of the Specific Plan process has diverged somewhat from the expectations that <br />informed the plan. In particular, the annexation subsequent to plan adoption did not include the <br />entire Happy Valley area, most of the previously developed portion of Happy Valley declining to <br />be annexed. It is not clear to us at present whether the more limited annexation affected the <br />implementation of other elements of the HVSP including (for example) extension of water and <br />sewer lines and the improvement of the drainage system. <br />Since the Greenbriar proposal can be approved only in a context of revision of the Specific Plan <br />(and the Genera] Plan, as needed and appropriate), we would expect staff to formulate those <br />revisions to the City's plans in tandem with the preparation of the EIR. <br />City's management of the CEQA process. <br />Designation of a project manager is .needed to provide direction and guidance to the consultant, <br />and to work with us in malting sure we have complete and accurate information, The project <br />manager would also presumably be the City's lead person in preparing or superintending <br />revisions in the City's planning documents to reflect the applicant's plan. <br />Other process issues include (a) consultant's role in public meetings (if any - we are assuming no <br />public scoping session is needed), (b) consultant's role in. public hearings, (c) the form of the <br />SEIR (print only or also electronic for web availability), (d) responsibility for printing, number <br />of copies, and provision for distribution of printed documents (usually roles the City assumes), <br />and (e) consultant's role (if any) in drafting of findings. There may be other matters staff might <br />bring to our attention that we are not aware of at present. <br />The prior EIR is detailed, we]]-organized, and still mostly relevant. Therefore, we propose to begin <br />work immediately, and adjust the scope in a month or so when the current uncertainties are resolved, <br />rather than delay the schedule. <br />2~f;_ PROPOSED PROJECT-.., ; .,,: , ,,:w:., ~. ~~ ,~. <br />The project the consultant would undertalte is the update of the Happy Valley Specific Plan EIR. The <br />form of the document to be prepared is a Supplemental Environmental Impact Report (SEIR) as <br />provided in the CEQA Guidelines §15166. We have reviewed the Guidelines with respect to the <br />available choices for updating an EIR -Addendum, Supplement, and Subsequent -and concur in the <br />City's conclusion that a Supplement to the earlier EIR is applicable in this situation. The Supplement <br />must address ariy changes in the Specific Plan needed to accommodate the project, as well as the <br />differences in environmental effects that would result from the change in location and type of <br />development (e.g., road alignment and residential density) that have been proposed by Greenbriar. <br />• Residential Development Proposal ~ <br />Greenbriar's project is a response to the fact that SummerHill's proposal for the 15-acre MDR area in <br />the Spotorno Upper Va]]ey - a maximum of 75 units -was rejected due primarily to geotechnical <br />considerations.
