ATTACHMENT 2 <br />CITY OF PLEASANTON <br />CONTRACT FOR CONSULTANT SERVICES <br />HAPPY VALLEY SPECIFIC PLAN <br />ENVIRONMENTAL IMPACT REPORT <br />SUPPLEMENT <br />THIS AGREEMENT is made and entered into this alstday of ~~~,wt,l~y , 2004, by <br />and between the CITY OF PLEASANTON, a municipal corporation (hereinafter referred to as the <br />"City"), and MiJNDIE & ASSOCIATES, a Planning Consulting Firm, whose address is <br />3452 Sacramento Street, San Francisco, California, 94118-1914, and telephone number is <br />(415) 441-9640 (hereinafter referred to as the "Consultant"). <br />WITNESSETH: <br />A. Greenbriar Homes Communities (hereinafter referred to as "Greenbriar") has <br />submitted an application to modify the Happy Valley Specific Plan and for development plan <br />approval fora 97-unit project, and the City has determined that a Supplement to the Happy Valley <br />Specific Plan Environmental Impact Report (EIR) is required. <br />B. Consultant is qualified to provide, and experienced in providing, environmental <br />impact report preparation services and has offered its services for the purposes specified in this <br />Agreement. <br />C. In the judgment of the City, it is necessary and advisable to employ the services of <br />Consultant for the purposes provided herein. <br />NOW, THEREFORE, in consideration of the mutual covenants, agreements, and <br />conditions contained herein, City and Consultant agree as follows: <br />1. Consultant's Services. Consultant shall diligently perform the services and furnish <br />the materials, reports, drawings, and related materials as hereinafter set forth: <br />a. Consultant shall perform all work described in Exhibit "A," Proposal (dated July 23, <br />2004), attached hereto and incorporated herein by this reference. <br />
