BACKGROUND <br />On September 21, 2004, the City Council approved a contract with Mundie & <br />Associates for consultant services in an amount not to exceed a total of $93,500 for the <br />preparation of a Supplemental Environmental Impact Report (EIR) for the Happy Valley <br />Specific Plan modifications and project approval, Spotorno Ranch (PUD-52). <br />The cost to prepare the Supplemental EIR has since exceeded the initial estimated <br />budget, and on March 6, 2006, a first amendment to the consultant contract was <br />approved by the City Manager to increase the budget by $21,783. <br />DISCUSSION <br />The Environmental Impact Report (EIR) for the Happy Valley Specific Plan modification <br />and the proposed PUD development plan for the Spotorno property have been an <br />ongoing effort. As the work has progressed, various interrelated impacts have been <br />discovered, therefore, have required more time than originally anticipated. This has <br />resulted not only in additional work but also increased labor and materials costs. A <br />second contract amendment is now being requested to increase the budget by $90,000 <br />to accommodate services not currently specified in the scope of work, including visual <br />analysis with the resolution of the Bypass Road alignment issue, detailed analysis of <br />Happy Valley Specific Plan changes, and preparation of updated maps. The project <br />applicant has agreed to pay this amount. <br />Furthermore, City staff anticipates that this project may result in future requests for EIR <br />contract increases as additional issues arise. Therefore, staff recommends that the City <br />Council authorize the City Manager to execute contract amendments up to a total <br />contract amount of $275,000. After payment of the proposed second contract <br />amendment in the amount of $90,000, the City Manager would be able to execute future <br />amendments up to $69,716. Amendments requested above the total contract amount <br />would return to the City Council for review and approval. <br />Staff notes that the EIR will include an analysis of the impacts of the Save Pleasanton's <br />Hills and Housing Cap Initiative currently being circulated for signatures. This initiative, <br />if adopted by Pleasanton voters, would amend the General Plan by adding a policy <br />which would limit development and grading on slopes of 25 percent or greater or within <br />100 vertical feet of a ridgeline.
