THE CITY OF <br />- ~ ~ -~- ~ ' CITY COUNCIL AGENDA REPORT <br />j~L£~S~4NTONo <br />January 15, 2008 <br />City Attorney <br />TITLE: AMENDMENTS TO THE PLEASANTON MUNICIPAL CODE REQUIRING <br />PERSONS WHO DISPUTE A CITY TAX TO FILE A CLAIM FOR A REFUND <br />WITHIN ONE YEAR OF PAYMENT OF THE TAX AND FOLLOW CLAIM <br />FILING REQUIREMENTS <br />SUMMARY <br />Government Code Section 935 authorizes cities to adopt an ordinance establishing <br />claim-filing requirements and time limitations for persons who wish to file a refund claim <br />for a disputed tax payment. The proposed amendments to the City's municipal code: <br />(1) tighten up the timeline for persons to file a claim to dispute a tax payment; (2) <br />establish a process for persons who wish to file a claim; and (3) bar claims from being <br />filed on behalf of a class of persons unless verified by every member of the class. <br />RECOMMENDATION <br />Introduce the attached ordinance to amend Sections 1.04.090, 3.20.120 and 5.24.030 of <br />the Pleasanton Municipal Code. <br />FINANCIAL STATEMENT <br />There will be no fiscal impact by reason of the adoption of this ordinance. By adopting <br />this ordinance, the time in which to file claims against the City will be tightened. <br />
