services have been furnished by outside sources, (as
<br /> approved by the CLIENT}, an additional ten percent
<br /> (10%) of the cost of these services shall be added for
<br /> the CONSULTANT'S administrative and CONTINUING PROJECT
<br /> responsibilities.
<br />
<br />E. That, if payment of the amounts due as prescribed in
<br /> ARTICLE 2, or any portion thereof, is not made within
<br /> 30 days after the period specified in ARTICLE 3, inter-
<br /> est on the unpaid balance thereof will accrue at the
<br /> rate of one and one-half percent (1½%) per month, or
<br /> the prime rate, whichever is greater, and will become
<br /> due and payable at the time said overdue payments are
<br /> made.
<br />
<br />F. That, if any services covered by this AGREEMENT to be
<br /> carried out by the CONSULTANT shall be suspended,
<br /> abated, or abandoned, the CLIENT shall pay the CONSUL-
<br /> TANT for the services rendered through such date of
<br /> suspension, abatement or abandonment for such sus-
<br /> pended, abated, or abandoned work, the payment to be
<br /> based insofar as possible on the fees as established in
<br /> the AGREEMENT or, where the AGREEMENT cannot be ap-
<br /> plied, the payment shall be on the basis of fees for
<br /> ADDITIONAL SERVICES, as prescribed in ARTICLE 2.
<br />
<br />G. That, insofar as the work under this AGREEMENT may re-
<br /> quire, the CLIENT shall furnish the CONSULTANT all
<br /> existing maps, field survey data, schedules, cost re-
<br /> ports, contracts, utility maps, records, reports, and
<br /> all other pertinent data presently available to the
<br /> CLIENT.
<br />
<br /> That, in purchasing materials, equipment, and services
<br /> for the CLIENT, other than those items noted in the
<br /> paragraph defining "direct expenses" in this article,
<br /> the CLIENT shall pay the actual cost of these mate-
<br /> rials, equipment, and services plus an added fee of
<br /> ten percent (10%) of the cost of such items.
<br />
<br /> I. That, the CONSULTANT shall not pay for the cost of pub-
<br /> lishing advertisements for bids and for permits and
<br /> licenses that may be required by local, state, or fed-
<br /> eral authorities, unless authorized to do such by the
<br /> CLIENT.
<br />
<br /> J. That, CONSULTANT shall not pay for costs of personnel
<br /> and equipment for tests borings, subsurface explora-
<br /> tions, or other investigations required for the deter-
<br /> mination of foundation and geologic conditions, for
<br /> field tests of equipment of facilities and shall not
<br /> pay for required chemical, mechanical, or other tests,
<br /> without the prior approval of the CLIENT.
