14S <br />THE CITY Of <br />pL£~S~4NTONe <br />Supplemental <br />CITY COUNCIL AGENDA REPORT <br />December 1 S, 2007 <br />City Manager's Office <br />TITLE: SUPPLEMENT TO ITEM 14: ELECTION AND CAMPAIGN FINANCE. <br />RECOMMEND THAT COMMITTEES ALSO BE REQUIRED TO <br />ELECTRONICALLY FILE CAMPAIGN STATEMENT <br />This information supplements and modifies staff's recommendation regarding <br />mandatory electronic filing of campaign statements. <br />The original staff report and proposed ordinance recommended that candidates and <br />candidates' committees be required to electronically file campaign statements with the <br />City Clerk's Office. <br />Staff now proposes that the electronic filing requirement be expanded to include those <br />committees which already are required to file campaign statements with the City Clerk, <br />such as independent expenditure committees or political action committees (PACs) <br />which are focused on local Pleasanton issues. This would include a "city general <br />purpose committee", which is defined by the Government Code as "a committee to <br />support or oppose candidates or measures voted on in only one city", as well as a <br />"primarily formed committee", which under State law are "committees formed or existing <br />primarily to support or oppose candidates or local measures to be voted upon in one <br />city". <br />The language of the proposed ordinance has been amended (see attached) to provide <br />that committees which file campaign statements with the City Clerk's Office shall also be <br />required to file campaign statements electronically. Committees, such as a "city general <br />purpose committee" or a "single purpose committee", are already included in the <br />definition of "committee" in Section 1.20.020.C. of the Pleasanton Municipal Code, as: <br />"any persons organized to conduct or aid the election campaign, including fundraising <br />events, of any candidate for City office, or for the support or defeat of a measure under <br />consideration in the City." Therefore, by deleting the word "candidate's" prior to the <br />word "committee", the revised proposed ordinance would require electronic filing of <br />campaign statements by candidates and all committees which otherwise file with the <br />City Clerk's Office. <br />
