OTHER TRI-VALLEY CITIES' CONTRIBUTION LIMITS. In the Tri-Valley, the <br />Cities of Dublin and Livemnore have adopted contribution limits of $300 and $250, <br />respectively. San Ramon does not have a contribution limit. <br />OUT-0F-ARFJ~1 CONTRIBUTORS. In acknowledgement of freedom of speech <br />and association, contribution limits may not distinguish between local contributors <br />versus contributors from outside of the City. In practice, interested pen~ns may review <br />the Campaign Statements, which list the name, address, occupation and place of <br />employment for every person contributing $25.00 or more (in cash or equivalent) to a <br />candidate or candidate's committee, to determine what amount of support a candidate <br />receives from outside of the City. <br />Providing Direction to Staff about Umits on Contributions. If the City <br />Council considers enacting an ordinance to limit contributions by <br />individuals, businesses, organizations or committees to candidates for <br />local office, the City Council should provide staff with direction regarding <br />the following issues: <br />- Amount of limit (e.g. $250, $300, or some other amount) <br />- Election period during which limit would be in force, for example: <br />Option 1 -Allow contributions to begin 31 days (or some ocher period] <br />following the prior election, and allow contributions to continue only until 7 <br />days prior to the date of the election at issue -which will allow all <br />contributions to be reported in the final Campaign Statement due 4 days <br />prior to the election. <br />Option 2 - Allow contributions to begin 31 days (or some other period) <br />following the prior election, and allow contributions to be made for a set <br />number of days after the election date, which will allow for campaign debt <br />retirement. <br />Option 3 - Allow the contributor to indicate which election the contribution <br />is intended to apply to, and allow contributions to be made after an <br />election date to be attributed to the just-decided election for a set period of <br />time. <br />Expenditure Limit -Voluntary Pledoe. <br />Expenditure limits are a direct restraint on speech and association. Expenditure limits <br />have only been legally upheld when tied to the acceptance of public funds for an <br />election campaign. As no city in Calffomia has provided public funding of campaigns for <br />local office, expenditure limits are utilized only as voluntary pledges. <br />Page3of6 <br />
