BACKGROUND <br />Tracts 7381 and 7429, Ironwood Development (Busch Property), developed by <br />Ponderosa Homes, consist of 16 and 55 single-family residential lot subdivisions, <br />respectively. Tract 7381 and 7429 are located north of Busch Road, east of Kamp Drive <br />and south of Mohr Avenue. <br />Tracts 7381 and 7429 are the third and forth of six subdivisions that make up the <br />Ironwood Development (Busch Property) to be accepted. Earlier, the Council accepted <br />Tracts 7430 and 7432 and some of the off-site public improvements required of the <br />development. <br />Improvements (to be accepted) <br />Four new public streets were constructed as part of Tract 7381 improvements, Ironwood <br />Drive, Ironwood Court, Reimers Drive, and Ledgestone Court. Ironwood Court and <br />Ledgestone Court are two cul-de-sacs containing the model homes for the development. <br />Reimers Drive provides access to the 23-acre parcel at the northeast corner of the <br />Busch/Ponderosa property (see Attachment 1). Ponderosa Homes has posted a <br />separate bond with the City to cover the cost of installing driveways to the model homes <br />and to repair the street once the fencing is removed after the model homes are sold. <br />Additionally, a secondary entrance to the City Operation Service Center (OSC) remains <br />to be constructed on the north side of the facility. The entrance into the OSC has also <br />been bonded and will be constructed prior to the acceptance of the last subdivision. <br />Five new public streets were constructed as part of Tract 7429 improvements, Donahue <br />Drive, Donahue Court, Wenig Court, Nolan Court and a portion of Baker Drive. <br />The storm drain system, sanitary sewer, and the water systems within the public streets <br />serving these tracts will be maintained and operated by the City. The Homeowners' <br />Association will maintain the bioswales along the streets, the planter strips between the <br />sidewalk and curb, as well as the emergency vehicle access. <br />City Council will be accepting for formal maintenance the public improvements as <br />described above. The developer has posted the required one-year warranty bond for <br />these improvements. <br />DISCUSSION <br />Tract 7433 (Bauer Court), asingle-family residential subdivision located at Baur Court <br />(a subdivision of Lot 55 of Tract 7429), was the last subdivision within the Ironwood <br />Development developed by Ponderosa Homes II. The subdivision improvements for <br />this tract were substantially installed with Tract 7429. However, since the final map was <br />just recently approved, the homes within Tract 7433 are still being constructed and <br />consequently the public improvements are not ready for acceptance. Ponderosa Homes <br />would like to have all of the Tract 7429 improvements accepted and their bonds <br />released. However, since a portion of the Tract 7433 improvements are not ready to be <br />accepted, staff is recommending, with Ponderosa Homes' agreement, to enter into a <br />new subdivision agreement for Tract 7433 and to post separate bonds guaranteeing the <br />Page 2 of 3 <br />
