Attachment A CITY OF PLEASANTON Department of Parks & Community Services AGREEMENT FOR FEE CLASSES , THIS AGREF~NT, is made and entered into ~n duplicate as of the day of , 19 , between the RECREATION DEPAR~{NT, of the City of Pleasanton, California, hereinafter referred to as "City' and , whose address ~s , phone number , hereafter referred to as "Instructor," as follows: _ 1. Instructor agrees to hold class or classes if at least students have enrolled for the course. City may cancel this agreement by notifying Instructor in writing of such cancellation, if fewer than students have enrolled for the course. 2. Instructor agrees to perform the following services 3. City shall pay Instructor for all services to be performed by Instructor hereunder, (by a City of Pleasanton check). Such total sum of money as shall be equal to % of proceeds collected by City during the term hereof ' from students enrolled for the course. ($3.00 out of city additional fee excluded and $2.00 late fee ~xcluded). 4. Instructor understands that City may cancel this agreement at any time should enrollment be insufficient or should funds or facilities become unavailable or should the Instructor not perform the services herein to the satisfaction of the City, and that City shall not be liable for compensation of Instructor for the remainder of the Agreement should it be cancelled. 5. Instructor shall acquire, repair and maintain at his sole cost and expense such equipment as Instructor needs for his personal use for the conduct of the aforesaid services. 6. Instructor, in the conduct of the services contemplated hereunder, shall abide by all laws, ordinances and by all rules and regulations adopted by the Recreation Department of the City of Pleasanton relating thereto. 7. It is understood and agreed the Instructor in the performance of this contract, is an independent instructor and not an employee of the Recreation Department or of the City of Pleasanton or of any organization, group or individuals under Instructor's supervision or leadership as a result of this contract, and is not subject to the control of the Recreation Department except as hereinabove stated. 8. Instructor further agrees to accept all hazards and injuries which Instructor may receive in the course of performing this contract and agrees to hold harmless the City of Pleasanton, the City Council and each member thereof, all officers and employees of the City of Pleasanton and any organization, group, or individual therein under the supervision of the Instructor, as a result of this contract, for any injury to Instructor or property of the Instructor which Instructor receives in the performance of his duties under the terms of this contract or for any act of which Instructor may be ad]udged liable. Instructor understands the City of Pleasanton or the Recreation Department have no accident or Wcrkmen's Compensation Insurance for persons performing services as an independent Instructor.
