PLANNING COMMISSION <br />City of Pleasanton <br />RESOLUTION NO. 1427 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF PLEASANTON DENYING THE REQUEST <br />OF LORIN MEDEIROS FOR A CONDITIONAL USE <br />PERMIT TO MAINTAIN AN ICE MACHINE IN THE <br />PARKING LOT SERVING HIS PLACE OF BUSINESS <br />AT 728 MAIN STREET. <br />REAS, Lorin Medeiros, the applicant and owner of Pleasanton <br />Liquors, has moved an eight foot by sixteen foot ice <br />machine onto the parking lot of Pleasanton Liquors <br />at 728 Main Street; and <br />REAS, the applicant failed to secure the necessary permits <br />from the City of Pleasanton; and <br />REAS, an ice vending station is a conditionally allowed <br />use in the C-C District; and <br />the location of the site on which the ice machine <br />has been placed is in the C-C District and the <br />Central Business District of the City of Pleasanton; <br />and <br />Mr. Medeiros is now applying for a conditional use <br />permit and design review approval in order to operate <br />the ice machine; and <br />the Planning Commission held a public hearing on this <br />conditional use permit application, reviewed the staff <br />report, site plan, and heard testimony; and <br />the Planning Commission has made the following findings: <br />a. That the proposed use would be injurious <br />to and detract from the properties and busi- <br />nesses in the central business district in that: <br />(1) an ancillary building constructed in a <br />parking lot adjacent to the primary business <br />is not in character with the Central Business <br />District; (2) approval of this use would set <br />a pattern and precedent for future ancillary <br />structures harmful to the future improvement <br />of the downtown area; and (3) such small <br />ancillary structures are out of character with <br />the Heritage Theme of the Central Business <br />District. <br />b. That the location of the proposed use would be <br />detrimental to the public health, safety and <br />welfare in that the site has a history of <br />disturbances involving young adults, requiring <br />frequent police calls; (2) while recognizing <br />the applicant has attempted to remedy the <br />
