Section 4. Section 2-11-26 (Action by Zoning Administrator) of ~~Article 26, Chapter 2, Title II, is hereby amended in its entirety is ~ i~-as follows: ~! "§2-11.26 Action by Zoning Administrator. a. If authorized by the Board of Adjustment, the ~ Zoning Administrator may grant, grant in modified (, _ form, condition or deny a request for a variance. The Zoning Administrator must make a decision on ! ~', a request on or before the tenth day following i j: receipt of the completed application. The Zoning ~{ Administrator shall mail a notice of the action taken to the applicant, the Board; adjacent pro- ~ perty owners or any others found by the Adminis- trator to be interested parties, on or before the fifth day following the decision. The Administra- f tor's decision shall become effective at 5:00 P.M. E on the fifteenth day following the decision unless I an appeal to the Board of Adjustment has been file j with the Planning Department prior to that time. b. Applications not decided by-the, Zoning Administra- tor shall be decided by the Board of Adjustment. Upon receipt of 'the completed application, the Zoning Administrator shall schedule a hearing at the earliest possible meeting of the Board, taking into account time necessary for staff preparation and public notice." Section 5. Subsection 1 of §2-11.28 (Action of the Board of Adjustment or Zoning Administrator), Article 26, Chapter 2, Title II; of the Ordinance Code of the City of Pleasanton is hereby amended in its entirety to read as follows: °§2-11.29 Findings. I 1. The'Board of Adjustment or the Zoning Administrator .may grant a variance to a regulation prescribed by this chapter with respect to fences, walls, hedges, ~ screening, or landscaping; site area, width, frontage; or depth; front, rear, or side yards; basic floor i area; height of structures; distances between !' structures; courts; e~ usable oven space; or other regulations of this chapter but a variance shall not be granted for a parcel of property for a use or a activity not expressly authorized by the zone regu- ? lation governing the parcel of property. Variances from these regulations may be granted only when the Board of Adjustment or the Zoning Administrator finds: that the follo~~ring circumstances apply: t That because of special circumstances applicable to the property, including size, shape, topography location or surroundings,. the strict application of the provisions of this chapter deprives such property of privileges enjoyed by other properties in the vicinity and under identical zoning class- ~ ification. ~ -2-
