Section 4. Section 2-11-26 (Action by Zoning Administrator) of <br />~~Article 26, Chapter 2, Title II, is hereby amended in its entirety <br />is ~ <br />i~-as follows: <br />~! "§2-11.26 Action by Zoning Administrator. <br />a. If authorized by the Board of Adjustment, the ~ <br />Zoning Administrator may grant, grant in modified <br />(, _ form, condition or deny a request for a variance. <br />The Zoning Administrator must make a decision on ! <br />~', a request on or before the tenth day following i <br />j: receipt of the completed application. The Zoning <br />~{ Administrator shall mail a notice of the action <br />taken to the applicant, the Board; adjacent pro- <br />~ perty owners or any others found by the Adminis- <br />trator to be interested parties, on or before the <br />fifth day following the decision. The Administra- <br />f tor's decision shall become effective at 5:00 P.M. <br />E on the fifteenth day following the decision unless <br />I an appeal to the Board of Adjustment has been file <br />j with the Planning Department prior to that time. <br />b. Applications not decided by-the, Zoning Administra- <br />tor shall be decided by the Board of Adjustment. <br />Upon receipt of 'the completed application, the <br />Zoning Administrator shall schedule a hearing at <br />the earliest possible meeting of the Board, taking <br />into account time necessary for staff preparation <br />and public notice." <br />Section 5. Subsection 1 of §2-11.28 (Action of the Board of <br />Adjustment or Zoning Administrator), Article 26, Chapter 2, Title <br />II; of the Ordinance Code of the City of Pleasanton is hereby <br />amended in its entirety to read as follows: <br />°§2-11.29 Findings. I <br />1. The'Board of Adjustment or the Zoning Administrator <br />.may grant a variance to a regulation prescribed by <br />this chapter with respect to fences, walls, hedges, ~ <br />screening, or landscaping; site area, width, frontage; <br />or depth; front, rear, or side yards; basic floor i <br />area; height of structures; distances between !' <br />structures; courts; e~ usable oven space; or other <br />regulations of this chapter but a variance shall not <br />be granted for a parcel of property for a use or <br />a <br />activity not expressly authorized by the zone regu- ? <br />lation governing the parcel of property. Variances <br />from these regulations may be granted only when the <br />Board of Adjustment or the Zoning Administrator finds: <br />that the follo~~ring circumstances apply: <br />t <br />That because of special circumstances applicable <br />to the property, including size, shape, topography <br />location or surroundings,. the strict application <br />of the provisions of this chapter deprives such <br />property of privileges enjoyed by other properties <br />in the vicinity and under identical zoning class- ~ <br />ification. ~ <br />-2- <br />
