ii <br />D R_ A_ F T <br />CITY COUNCIL OF THE CITY OF PLBASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE N0. <br />AN ORDINANCE AMENDING PORTIONS OF ARTICLE 26 (VARIANCES), <br />CHAPTER 2 (ZONING), TITLE II (ZONING AND DEVELOPP~NT) <br />RELATING TO THE AUTHORIZED PURPOSES FOR GRANTING VARI- <br />ANCES FROM THE ZONING CODE, THE DATA TO BE FURPIISHED <br />AS PART OF THE APPLICATION FOR A VARIANCE AND THE <br />FINDINGS TO BE MADE BY THE BOARD OF ADJUSTP4ENT OR A <br />ZONING ADMINISTRATOR IN GRANTING A VARIANCE. <br />CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />I~~ection 1. Subsection (a) of Section 2-11.23 (Purposes and Au <br />I <br />y), Article 26 (Variances), Chapter 2 (Zoning), Title II (Zoning <br />d Development) of the Ordinance Code of the City of Pleasanton <br />~~is hereby amended in its entirety to read as follows: <br />"§2-11.23 Purposes and Authorization. <br />a. In order to prevent a particular property from <br />being deprived of privileges enjoyed by other <br />properties in the vicinity and under the identi- <br />cal zoning classification due to special circum- <br />stances applicable to the property, the Board <br />of Adjustment is empowered to grant variances." <br />action 2. Section 2-11.24 (Board of Adjustment: Membership and <br />~etings) of Article 26, Chapter 2, Title II, is hereby amended <br />read as follows: <br />j "§2-11.24 Board of Adjustment: Membership and Meetings. I <br />!+ The Board of Adjustment shall be composed of at least three <br />members of the City Planning Commission appointed by the <br />chairman of the Commission. If the Board does not include <br />j the full Commission, its members shall be appointed for <br />l~ one year terms and shall serve until their successors are F <br />appointed. If the Board does not include the full Commis- <br />Sion, the Board shall elect a chairman who shall serve a ~ <br />I' one year term. The Board shall hold at least one regular <br />(~ meeting each month, provided that a meeting need not be ' <br />held if no matters have been submitted for consideration <br />of the Board." <br />Section 3. Subsection 1(d) (Data and P,1aps to be Furnished) of <br />§2-11.25 (Application and Fee), Article 26, Chapter 2, Title II of <br />i <br />the Ordinance Code of the City of Pleasanton is hereby amended in <br />~".its entirety to read as follovrs: <br />"d.
