The State indicated they simply needed Fire approval and a <br />safety check and he voiced concerns over the Code. <br />Mayor Hosterman reported a Stop Work Notice was issued today and she asked Mr. Iserson to <br />comment on the matter. <br />Director of Planning and Community Development Iserson said in terms of design of the <br />handicap ramp and front yard, the zoning ordinance does not require that type of structure go <br />through design review. Staff is working with the owner of the property to install landscaping and <br />plant material in front of the ramp and paint it to match the house in order to blend in better. <br />Regarding building issues, the homeowner did receive a building permit but never called for <br />inspections. Now that staff is aware the structure was not built correctly, a Stop Work Notice <br />was issued and staff will work to correct the issues with the property owner. Also, the Planning <br />Commission has requested staff return with suggestions on whether or not the City wants to <br />continue not requiring design review on such structures. <br />Victoria DeRossett also addressed Council and expressed concerns related to the assisted <br />living facility. <br />Ralph Cloud, Livermore resident, spoke on the FBO at Livermore Airport and said he served 8 <br />years on the Airport Advisory Commission. He said when aircraft pilots plan a trip, they look at <br />facilities and adding an FBO providing full services by itself will not bring more aircraft to <br />Livermore. There are two full service operators in Hayward, but people come to Livermore <br />because they have business in the area. He said the 15% increase in fuel will add to the <br />economy and will not increase aircraft to have the full service operation. He said the airport <br />brings $52 million annually to the economy of the entire valley from travelers, he noted the <br />economic development link on the City's website identifies the airport as an asset to bring <br />businesses to Pleasanton. <br />Kevin Close thanked the Council for the first phase of the traffic calming with radar signs in <br />Happy Valley, voiced concerns with noise and traffic caused by the Happy Valley loop, <br />suggested putting money toward a bypass road and said the Happy Valley Blue Ribbon <br />Committee finished its charge one year ago. The Council approved their recommendation six <br />months ago, said nothing has been done to date as a result and he questioned its status. <br />City Manager Fialho said the Council did take action to change the alignment and staff has <br />communicated this to the affected property owner who is processing a development application <br />through the City. Staff is also studying the new alignment as part of the EIR and he felt the <br />development application and EIR will come forward sometime early in 2008. <br />Ann Luce said in the last 3-5 years, there has been a lot more noise. She has never complained <br />until November 1 S` where from 12:30 to 6:00 p.m. there were non-stop take-off's which she <br />recorded and the noise was unbelievable. She wrote to the airport and they wrote back and said <br />they "...regret she was disturbed by airplane noise, federal law prohibits the airport from <br />denying or limiting access to any aircraft that can safely use the airport on a 24-hour basis. <br />Further, the City cannot impose any noise related regulations, curfews or penalties. Any actions <br />the City can take with pilots regarding aircraft noise must be voluntary in nature. On an ongoing <br />basis, staff provides information to pilots regarding the voluntary restraint from night-flying policy <br />from 10:00 to 6:00 a.m. and noise sensitive areas adjacent to the airport via pilot brochures, <br />letters, meetings and flight schools. Their complaint has been registered.° She felt the City <br />cannot limit the volume of aircraft traffic, said there are no nighttime restrictions because they <br />City Council Minutes 5 November 6, 2007 <br />
