1. That the development be substantially as shown on <br />the site plan, elevations, landscape plan, Exhibit <br />A, on file with the Planning Department, except <br />that the applicant may, at his option, extend the <br />building to the southerly property line. If the <br />applicant chooses to extend the building, Condition <br />No. 2 shall not apply; prior to issuance of a <br />building permit the revised plans shall be sub- <br />mitted to the Planning Department for approval. <br />2. That because the subject property is bordered on <br />the south by land scheduled for multiple residentia <br />use, the 12 ft. wide roll up door planned for the <br />southern side of the building be sealed and no <br />longer used once residential development takes plac <br />on the property immediately south of the subject <br />site. <br />3. That approval of this case is conditioned upon the <br />approval of case Z-76-197 and all conditions which <br />may be attached thereto by the Design Review Board. <br />4. That the vacant area between the proposed building <br />and Santa Rita Road be kept clear of weeds at all <br />times. <br />5. That any damage done to street improvements now <br />existing or done during construction on the subject <br />site be repaired at full expense to the developer. <br />6. That because the development will increase traffic <br />on Santa Rita Road, the owner dedicate to the city <br />a strip of land 2 ft. in width along the full Santa <br />Rita Road frontage of the subject property for <br />street right-of-way purposes. <br />7. That because the subject property is in a Special <br />Flood Hazard Area as defined by the National Flood <br />Insurance Act of 1968 as amended, the developer <br />shall, prior to the issuance of any building permit <br />on the subject property, meet all requirements of <br />the Act with respect to: protecting the site from <br />flooding, or flood proofing all buildings on the <br />site (as determined by the city); said flood pro- <br />tection or flood proofing will not be required if <br />the developer can obtain an exemption or variance <br />from the requirements of the Act from the Federal <br />Insurance Administration or a guarantee from the <br />administration that they (the administration) will <br />hold the City harmless from the effects of any <br />flooding that might take place on the subject site <br />and that they (the Administration) will not revoke <br />the City's participation in the National Flood In- <br />surance Program for allowing the construction of <br />buildings intended for human occupancy on the site. <br />-2 - <br />
