under which it would be operated or maintained <br /> will not be detrimental to the public health, <br /> safety or welfare, or materially injurious to the <br /> properties or improvements in the vicinity. <br />b. That the proposed location of the conditional use <br /> is in accord with the objectives of this chapter <br /> and the purposes of the district in which the <br /> site is located, as the condtions imposed for the <br /> granting of the use would be so written as to <br /> avoid possibility of the (pool) becoming an <br /> attractive nuisance and police problem. <br />c. That the proposed conditional use will comply with <br /> each of the applicable provisions of Chapter 2, <br /> Title II of the Ordinance Code. <br />NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES AS FOLLOWS: <br />Section 1. Approve UP-77-2, subject to the following conditions: <br />1. That approval of this use permit is conditioned <br /> upon the approval of case 7-76-209 and all con- <br /> ditions which may be attached thereto by the Design <br /> Review Board. <br />2. That the pool shall be provided with a complete <br />cover which will effectively prohibit the pool <br />from being used for swimming purposes. That the <br />design of this pool cover be approved by the Depart- <br />ment of Public Safety prior to completion of the <br />pool and that the pool be covered at all times <br />that the Sunset Pools office is not open for business <br />3. That prior to construction, the applicant shall <br />post a bond in the form and amount acceptable <br />to the City Attorney to insure that the swimming <br />pool will be removed, pool hole filled and ground <br />level restored, should the use on the site for <br />swimming pool sales cease. <br />4. That the pool be equipped with an alarm system <br />approved by the Department of Public Safety, <br />said system to be activated any time any unauthor- <br />ized person attempts to utilize the display pool <br />area. <br />-2- <br />
