DES:djk 12/15/86 (#30) <br /> <br /> WHEREAS, further pursuant to the provisions of paragraph <br />XXII of the Joint Powers Agreement, Livermore and Authority <br />entered into an agreement under which Livermore contributed funds <br />to Authority for Livermore's requested proportionate share of a <br />proposed project of Authority and payment has been made in <br />accordance with said agreement; and <br /> <br /> WHEREAS, paragraph XXI of the Joint Powers Agreement <br />provides that new Parties may be added as members of Authority by <br />supplemental agreement to the Joint Powers Agreement; and <br /> <br /> WHEREAS, the parties hereto desire that Livermore shall be <br />added as a member of Authority; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. MEMBERSHIP. From and after the effective date hereof, <br />Livermore shall be, and hereby is, a Member of the Authority and <br />a Party to the Joint Powers Agreement, accepting the rights and <br />obligations pertaining thereto. <br /> <br /> 2. DESIGNATION OF BOARD. Paragraph VIII of the Joint <br />Powers Agreement is hereby amended to read as follows: <br /> <br /> "VIII. Designation of Board. The Authority shall be <br /> administered by the Board, the members of which shall be <br /> selected and serve as follows: <br /> <br /> "(a) Primary Directors shall be designated and <br /> appointed by each party within thirty (30) days after the <br /> Effective Date hereof.
