DES:djk 12/15/86 (#18) <br /> <br /> R E S O L U T I O N TWA NO. 86 - 14 <br /> <br /> RESOLUTION APPROVING AND RECOMMENDING EXECUTION OF <br /> SUPPLEMENTAL AGREEMENT I TO THE JOINT EXERCISE OF <br /> POWERS AGREEMENT FOR TRI-VALLEY WASTEWATER AUTHORITY <br /> <br /> WHEREAS, this Authority was established and exists pursuant <br />to a Joint Exercise of Powers Agreement dated March 4, 1986 (the <br />"Joint Powers Agreement") entered pursuant to the provisions of <br />Government Code Sections 6500 et seq.; and <br /> <br /> WHEREAS, paragraph XXII of the Joint Powers Agreement <br />provides that a party or parties may be added to the Authority <br />upon request, evidenced by submission of a certified copy of a <br />resolution adopted by the governing body from the public entity <br />requesting membership; and <br /> <br /> WHEREAS, this Board has received a certified copy of <br />Resolution No. 250-86 entitled, "A Resolution Requesting <br />Membership in the Tri-Valley Wastewater Authority", adopted <br />September 8, 1986 by the Council of the City of Livermore, <br />California; and <br /> <br /> WHEREAS, this Authority and the City of Livermore entered <br />into an agreement approved by this Board pursuant to Resolution <br />TWA No. 86-10 adopted November 12, 1986, which, among other <br />matters, provided for payment by said City to this Authority of <br />said City's proportionate share of costs heretofore incurred by <br />this Authority for a proposed Project; and <br /> <br /> WHEREAS, payment of said proportionate share has been made <br />in accordance with the terms and conditions of said agreement; <br />and <br /> <br /> <br />
