DES:djk 12/15/86 (#30) <br /> <br />Operation and Maintenance Costs as the Participating Members <br />shall agree. Except when based on estimated flows or other <br />pollutant loadings prior to the first full year of operation of a <br />Facility or Facilities, such flow shall be determined from the <br />total recorded flows and measured loadings obtained from the <br />twelve (12) months prior to March 1 preceding the adoption of the <br />General Budget for an ensuing fiscal year. In the event <br />incomplete or inaccurate records are kept by a Member or Members, <br />the Board shall appoint an Advisory Committee to review the data <br />and determine the appropriate total annual flow or other <br />pollutant loadings. <br /> <br /> Each Party shall be responsible for the professional <br />installation and ongoing professional maintenance of measuring <br />devices and the performance of tests or other collection of data <br />to indicate the amount of wastewater flow or other pollutant <br />loadings generated by a Member. Accurate records pertaining to <br />the measuring devices, tests, or other collection of data shall <br />be maintained by the Party responsible therefore, and such <br />records shall be subject to reasonable inspection by any Party to <br />this Agreement. <br /> <br /> Section 2: Capital Expenditures Budget. Each Party's share <br />of funds required to finance the expenditures to construct a <br />Facility or Facilities for a Project or Projects shall be based <br />upon its anticipated required Capacity Rights over the life of <br />the Facility or Facilities.
