PLANNING COMMISSION City of Pleasanton RESOLUTION N0. 1335 A resolution of the Planning Commission of the City of Pleasanton approving UP-75-4. WHEREAS, the application of Pleasanton Garbage Service for a conditional use permit to construct a refuse transfer station on the south side of Busch Road, approximately one-half mile east of the Southern Pacific Railroad tracks, at property commonly known as 3110 Busch Road, Pleasanton; zoning for the property being I-G (General Industrial) District has come before this Commission; and WHEREAS, the Planning Commission of the City of Pleasan- ton has held a public hearing on this appli- cation and examined pertinent maps, drawings and documents. NOW, THEREFORE, the Planning Commission of the City of Pleasanton does hereby resolve as follows: Section 1. Findings-. a. The proposed use is in accord with the objectives of Chapter II (Zoning), Title II (Planning and Zoning) of the Ordinance Code of the City of Pleasanton, as specifically set forth in Section 2-7.17 and the general purposes of the I-G (General Industrial) District within which the proposed use is to be located (as specified in Section 2-7.18a). b. The proposed location of the conditional use and the conditions under which it will operate or be maintained will not be detri- mental to the public health, safety, or welfare, or materially injurious to properties in the vicinity. This finding is based upon the fact that the transfer station will occur within an enclosed structure; the existing structure has been used for general industrial type uses; the transfer trucks will be using a route other than City streets; and the permit is being granted subject to conditions neces- sary to protect the public health, safety and welfare as well as to protect adjacent pro- perties. c. The proposed use will comply with each applicable provision of this chapter - other- wise the use permit is subject to revocation and potential misdemeanor action or civil action to enforce compliance.
