PLANNING COMMISSION <br />City of Pleasanton <br />RESOLUTION N0. 1335 <br />A resolution of the Planning Commission of <br />the City of Pleasanton approving UP-75-4. <br />WHEREAS, the application of Pleasanton Garbage Service <br />for a conditional use permit to construct a <br />refuse transfer station on the south side of <br />Busch Road, approximately one-half mile east <br />of the Southern Pacific Railroad tracks, at <br />property commonly known as 3110 Busch Road, <br />Pleasanton; zoning for the property being <br />I-G (General Industrial) District has come <br />before this Commission; and <br />WHEREAS, the Planning Commission of the City of Pleasan- <br />ton has held a public hearing on this appli- <br />cation and examined pertinent maps, drawings <br />and documents. <br />NOW, THEREFORE, the Planning Commission of the City of <br />Pleasanton does hereby resolve as follows: <br />Section 1. Findings-. <br />a. The proposed use is in accord with the <br />objectives of Chapter II (Zoning), Title II <br />(Planning and Zoning) of the Ordinance Code <br />of the City of Pleasanton, as specifically <br />set forth in Section 2-7.17 and the general <br />purposes of the I-G (General Industrial) <br />District within which the proposed use is to <br />be located (as specified in Section 2-7.18a). <br />b. The proposed location of the conditional <br />use and the conditions under which it will <br />operate or be maintained will not be detri- <br />mental to the public health, safety, or <br />welfare, or materially injurious to properties <br />in the vicinity. This finding is based upon <br />the fact that the transfer station will occur <br />within an enclosed structure; the existing <br />structure has been used for general industrial <br />type uses; the transfer trucks will be using <br />a route other than City streets; and the permit <br />is being granted subject to conditions neces- <br />sary to protect the public health, safety and <br />welfare as well as to protect adjacent pro- <br />perties. <br />c. The proposed use will comply with each <br />applicable provision of this chapter - other- <br />wise the use permit is subject to revocation <br />and potential misdemeanor action or civil <br />action to enforce compliance. <br />
