PLANNING COMMISSION <br />Pleasanton, California <br />RESOLUTION NO. 1346 <br />A resolution of the Planning Commission <br />of the City of Pleasanton approving <br />UP-75-10. <br />WHEREAS, the application of Vernon Dickman for a <br />conditional use permit to construct a <br />self-service gasoline station to be located <br />on the northwest corner of First Street <br />and Ray Street; zoning for the property <br />being C-S (Commercial Service) District <br />has come before this Commission, and <br />WHEREAS, the Planning Commission of the City of <br />Pleasanton has held a public hearing on <br />this application and has examined perti- <br />nent maps, drawings, and documents and <br />has made the following findings: <br />1. That the proposed location of the <br />conditional use is in accord with the <br />objectives of this chapter and the pur- <br />poses of the district in which the site <br />is located. <br />2. That the proposed location of the <br />conditional use and the conditions under <br />which it would be operated and maintained <br />will not be detrimental to the public <br />health, safety or welfare or materially <br />injurious to the property or improvements <br />in the vicinity. <br />3. That the proposed conditional use <br />will comply with each of the applicable <br />provisions of this chapter. <br />NOW, THEREFORE, BE IT RESOLVED that the Planning Commission <br />of the City of Pleasanton hereby approves <br />UP-75-10 subject to the following conditions: <br />1. That the development be substantially <br />as shown on the site plan, elevations and <br />landscape plan, Exhibit A, on file with <br />the Planning Department. <br />2. That approval of UP-75-10 is condi- <br />tioned upon the approval of the Board of <br />Adjustment of V-75-6 and the approval of <br />Z-75-56 and all conditions attached thereto. <br />3. That if the service station is period- <br />ically vacated and reopened during a period <br />of 18 months or is vacated and allowed to <br />lapse into a state of disrepair for a 6 <br />month period without any attempts to main- <br />tain the building and landscaping as re- <br />quired by this permit, then the property <br />owner or his successor in interest shall <br />cause all improvements on the site to be <br />removed at his full expense. <br />
