PLANNING COMMISSION Pleasanton, California RESOLUTION NO. 1363 A resolution of the Planning Commission of the City of Pleasanton approving UP-75-21. WHEREAS, the application of John Harris for a condi- tional use permit to operate a 2,240 square feet restaurant in the 0 (Office) District, at 234 Main Street, has come before this Commission, and WHEREAS, the Planning Commission of the City of Pleasanton has held a public hearing on this application and has examined pertinent maps, drawings and documents, and has made the following findings: A. That the proposed location of the con- ditional use is in accord with the objectives of this chapter and the purposes of the dis- trict in which the site is located. B. That the proposed location of the condi- tional use permit and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or materially injurious to the properties or improvements in the vicinity. C. That the proposed conditional use will comply with each of the applicable provisions of this chapter. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Pleasanton hereby approved UP-75-21, subject to the following condi- tions: 1. That approval of this case shall be based upon approval of case Z-75-111 and all conditions attached thereto. 2. That because off-street parking is limited on the site, the capacity of the restaurant be no more than 33 seats unless additional contiguous parking is provided or a variance from the parking requirements of the code is granted by the Board of Adjustment. 3. That the property owner confer with the Police Department and if a burglar alarm system is deemed necessary for all or part of the building by that department, that such a system be installed per all conditions of the Police Department. 4. That any damage to street improvements now existing or done during construction on the subject site be repaired at full expense to the developer.
