PLANNING COMMISSION <br />Pleasanton, California <br />RESOLUTION NO. 1363 <br />A resolution of the Planning Commission of <br />the City of Pleasanton approving UP-75-21. <br />WHEREAS, the application of John Harris for a condi- <br />tional use permit to operate a 2,240 square <br />feet restaurant in the 0 (Office) District, <br />at 234 Main Street, has come before this <br />Commission, and <br />WHEREAS, the Planning Commission of the City of <br />Pleasanton has held a public hearing on <br />this application and has examined pertinent <br />maps, drawings and documents, and has made <br />the following findings: <br />A. That the proposed location of the con- <br />ditional use is in accord with the objectives <br />of this chapter and the purposes of the dis- <br />trict in which the site is located. <br />B. That the proposed location of the condi- <br />tional use permit and the conditions under <br />which it would be operated or maintained <br />will not be detrimental to the public health, <br />safety or welfare or materially injurious <br />to the properties or improvements in the <br />vicinity. <br />C. That the proposed conditional use will <br />comply with each of the applicable provisions <br />of this chapter. <br />NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission <br />of the City of Pleasanton hereby approved <br />UP-75-21, subject to the following condi- <br />tions: <br />1. That approval of this case shall be <br />based upon approval of case Z-75-111 and all <br />conditions attached thereto. <br />2. That because off-street parking is <br />limited on the site, the capacity of the <br />restaurant be no more than 33 seats unless <br />additional contiguous parking is provided <br />or a variance from the parking requirements <br />of the code is granted by the Board of <br />Adjustment. <br />3. That the property owner confer with <br />the Police Department and if a burglar <br />alarm system is deemed necessary for all or <br />part of the building by that department, <br />that such a system be installed per all <br />conditions of the Police Department. <br />4. That any damage to street improvements <br />now existing or done during construction <br />on the subject site be repaired at full <br />expense to the developer. <br />
