and connection to City sewerage facilities; and <br /> <br /> WHEREAS, City policy is adequately preserved through the <br />provisions of an agreement wherein Owner consents to annexation <br />to City at such time as City may require; <br /> <br /> NOW, THEREFORE, City and Owner hereby agree as follows: <br /> <br /> 1. Provision of Sewer Service. City agrees to allow Owner <br />to connect to City's sanitary sewer system upon execution of this <br />agreement prior to annexation of Owner's land. Connection shall <br />be in accordance with the following: <br /> <br /> (a) Owner agrees to pay the then-existing sewer <br /> connection fee for 'connection to the sewer system <br /> in accordance with applicable City ordinances. <br /> <br /> (b) Owner agrees to pay all costs associated with <br /> extension of the sewer system to serve Owner's <br /> land, said system to be designed in accordance with <br /> City standards and subject to City approval. <br /> <br /> (c) Owner agrees to pay an amount computed in <br /> accordance with the applicable City formula for <br /> connection to sewer facility improvements subject <br /> <br /> to a mutual benefit district, reimbursement <br /> <br /> agreement, or any other agreement. <br /> <br /> (d) Owner agrees to pay a monthly sewer service charge <br /> <br /> as is now or may hereafter be specified by <br /> ordinance. <br /> <br /> 2. Agreement to Annex. Owner agrees to consent to annex to <br />the City of Pleasanton all those lands described herein at such <br />time as City may require.
