dfiEREAS, other members of the public in attendance at said meeting <br />were afforded the opportunity to speak in favor of and <br />against said application; and <br />;JHEREAS, after the conclusion of the public hearing, the Planning <br />Commission discussed the application, the testimony pre- <br />sented by the applicant, members of the public and the <br />staff and discussed the problems which have been experi- <br />enced in the past by the City with the location of a gas <br />station in this vicinity, especially in relation to <br />traffic; <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />DOES RESOLVE AS FOLLOWS: <br />Section 1. The application for a conditional use permit to allow <br />t e esta lishment of two pump islands at 707 Main Street, pursuant <br />to plans presented at the Planning Commission's meeting of August 27 <br />1975 which would allow the establishment of six dual dispensing <br />gasoline pumps having a total of 12 hoses, as more particularly <br />described in the staff report attached hereto and incorporated <br />herein as Exhibit A, is denied. <br />Section 2. The above denial is based upon the following grounds: <br />1. The Planning Commission cannot make the necessary <br />findings for a conditional use permit that the proposed <br />location of the use and the conditions under which it <br />would be operated or maintained would not be detrimen- <br />tal to the public health, safety or welfare, or mater- <br />ially injurious to property in the vicinity for the <br />following reasons: <br />(1) Although the present site is a non-conforming use, <br />this is a poor location for a gas station due to the <br />traffic congestion at one of the busier corners in the <br />City of Pleasanton. Automobiles desiring to use the <br />site have caused congestion for south bound traffic or <br />Main Street and automobiles leaving the gas station <br />often attempt to make illegal left turns at the inter- <br />section of St. Mary Street and Main Street with re- <br />sulting danger to automobiles making right hand turns <br />as well as to the automobile making the illegal left <br />hand turn. An expansion of the facility in question <br />beyond its present capabilities would compound this <br />traffic problem and would not help to alleviate the <br />situation. <br />(2) The City Council and the City Planning Commissioi <br />have encouraged improvements to the downtown area in <br />order to retain the heritage of the City of Pleasanton <br />The establishment of two isolated gasoline islands at <br />a prominent corner within the City is not in harmony <br />with the attempts to improve the downtown area but <br />caould rather be a detriment to improvements which <br />exist adjacent and in the proximity to said site. <br />tion 3.
