PLANNING COP'II~IISSION <br />CITY OF PLEASANTON <br />RESOLUTION N0. 75-1366 <br />RE: DENIAL OF UP-75-24, GRAFCO PETROLEUM <br />WHEREAS, at 707 Main Street, at the northwest corner of Main and <br />St. Mary Street, a small gas station has existed for <br />some time known as the"E-Z Pickins" Gas Station; and <br />WHEREAS, said gas station ceased operation on or about July 12, <br />1975; and <br />WHEREAS, subsequent to said date, the property upon which this <br />gas station is located was purchased by Mr. Carl Graf- <br />fenstatte, Jr., owner of Grafco Stations; and <br />WHEREAS, Mr. Graffenstatte, prior to the purchase of said gas <br />station site met with Mr. Robert Harris, Director of <br />Planning for the City of Pleasanton, and by letter dated <br />July 23, 1975 was advised by Mr. Harris that the gas <br />station in question was a non-conforming use which must <br />be reopened no later than October 12, 1975, in order to <br />retain said use without the necessity of a conditional <br />use permit; and <br />WHEREAS, Mr. Harris was not advised that Mr. Graffenstatte desire <br />to expand the use of said station beyond the four gaso•- <br />line hoses which had previously existed on the site but <br />instead wished to install dispensers which would total <br />approximately twelve hoses; and <br />WHEREAS, in order to replace gasoline tanks on the site, Mr. Graf <br />fenstatte procured from the Building Department a build- <br />ing permit which specifically indicated that its issuanc <br />did not waive other provisions of the Municipal Code and <br />at the time of issuance of said permit, the building <br />official was informed by the applicant that the station <br />had been approved by the Planning Division; and <br />WHEREAS, subsequent to the issuance of the building permit and <br />excavation for the three gasoline tanks, it came to the <br />City's attention that Mr. Graffenstatte desired to tripl <br />the number of dispensers of gasoline at the proposed <br />location which also would necessitate the construction o <br />a second pump island; and <br />WHEREAS, the City placed a stop-work order on the project on <br />August 12, 1975 and advised Mr. Graffenstatte that in <br />order to expand the facility it would be necessary for a <br />conditional use permit to be approved by the Planning <br />Commission of the City of Pleasanton; and <br />WHEREAS, on Wednesday, August 27, 1975, at 7:30 P.M., at the City <br />Administrative Offices, 200 Bernal Avenue, the Planning <br />Commission held a public hearing to hear a request by <br />I Grafco Stations for a conditional use permit (Application <br />No. UP-75-24); and <br />WHEREAS, Mr. Graffenstatte was in attendance, together with <br />Mr. Aaron Greenberg as legal counsel, and the applicant <br />and his representative were afforded an opportunity to <br />present their position on said conditional use permit to <br />the Planning Commission; and <br />
