WHEREAS, the effectuation of the phase out of the Sunol Plant was <br />contemplated by written agreement between the City of <br />Pleasanton and Valley Community Services District as <br />early as 1967, and the total implementation of said agree <br />ment has been hampered by changes over the ;~eass of <br />disposal requirements for the Valley Community Services <br />plant as a result of the 1970 Clean Water Act and forte <br />Cologne Act; and <br />6JfiEREAS, the only financial vehicle presently available to the <br />City for phaseout of the Sunol Plant is thru funding by <br />the Federal Government and State Government of expansion <br />of the Valley Community Services District plant; anti <br />WHEREAS, said expansion was contemplated by a settlement agreec~ent <br />dated November 8, 1972 which set forth priorities cahereb <br />previously approved developments would be sewered to thi <br />expanded VCSD ~Iant; and <br />'~iEREAS, the necessary State and Federal funding has not been <br />obtained due to changing circumstances, most specifical <br />the endeavors by the environmental Protection Agency to <br />rectify secondary ir.~pacts of sewage expansion (i.e., air <br />quality degradation) and the establishment by the State <br />of California Department of~inance of an E-0 population <br />projection series; and <br />WHEREAS, the State Water Resources Control Board has advised com- <br />munities in the Livermore-',mador Valley that the Depart- <br />ment of Finance's'i-0 population projection series will b <br />used as a basis for determining fundable sewage expansic <br />facilities; and <br />WHEREAS, said population figures provide that the fundable popula <br />tion for the City of Pleasanton by the year 1996 shall <br />be approximately 48,700 people; and <br />`HEPEAS, this population limitation on funding requires reconsid- <br />eration by the City of the rate at which t11e City of <br />-2- <br />
