The Planning Commission placed a prohibition on the inclusion of grills/ranges in the <br />drive through restaurant/cafe in the pad building to limit the types of fast-food <br />restaurants that can locate here. <br />Operations <br />The Home Depot's and Longs Drugs' operations are described in detail in the Planning <br />Commission staff report. <br />To ensure Home Depot's compatibility with the Congregation Beth Emek's activities, the <br />Planning Commission prohibited truck deliveries and/or the loading/off-loading of trucks <br />and delivery vehicles between the hours of 10:00 p.m. and 6:00 a.m. daily and from <br />8:00 p.m. to 10:00 p.m. on Fridays and from 8:00 a.m. to 1:00 p.m. on Saturdays. <br />To reduce the impact of Home Depot's delivery trucks on the Valley Avenue <br />neighborhoods, the Planning Commission required Home Depot's delivery trucks to use <br />a delivery route established by the City Engineer. Staff believes that Home Depot and <br />its vendors' delivery trucks should use an alternate route from State Route 84 to Stanley <br />Boulevard to the site directly bypassing the Valley Avenue neighborhoods and has <br />conditioned the project accordingly. The applicant has assured staff that Home Depot <br />can monitor and control its truck deliveries including vendors of the required delivery <br />route. <br />Home Depot Seasonal Sales <br />The Planning Commission modified the seasonal sales to allow other seasonal sales in <br />addition to Christmas tree sales on a case-by-case basis with a Temporary Conditional <br />Use Permit. The original condition stated that Christmas tree sales would be the only <br />permitted seasonal sales. <br />Staff discussed this condition with the applicant and worked out a new proposal to <br />permit up to four seasonal sales events in the 10,000 square-foot area designated on <br />the site plan, limited to Christmas tree sales from the week before Thanksgiving through <br />the Christmas season, and three additional seasonal sale events for no more than two <br />calendar weeks per event. Each seasonal sale will be reviewed by the Planning <br />Director. No other seasonal sales and/or shopping center events would be permitted in <br />the parking areas of this development. <br />Staff recommends this revised condition for the following reasons: <br />• The condition reflects the Pleasanton Municipal Code, which allows up to four, <br />three-day shopping center events meeting specified criteria, and avoids an open- <br />ended condition for seasonal sales that staff believes would be precedent setting <br />to other shopping centers. Staff notes that the tenants may have their own <br />shopping center events in front of their businesses so long as it takes place on <br />the sidewalks in front of their stores. <br />Page 16 of 22 <br />
