Staff considered approaches used by cities such as Campbell and Milpitas. All truck <br />deliveries for this development are limited by the conditional use permit and the <br />development plan to specific hours and routes. The condition of approval also <br />requires that an on-site monitor is present to enszcre compliance with these conditions <br />and that a monitoring plan be prepared for City approval. Providing a video camera <br />at the truck entrance would be a part of tJze plan so that truck arrivals/departures can <br />be documented. <br />• What can be done to preclude trucks from entering the site which used the wrong <br />route or which enter the site before opening hours? (Check City of Campbell). <br />The stoT°e owner^s and driveT~s of delivery trucks using the ~~~rong s7reets or hours <br />would be subject to an enforcement program. Police and code enforcement staff <br />would be especially vigilant in monitoring delivery trucks during the initial period of <br />the center's operation to ensure that truck drivers aJ°e educated as to the proper <br />delivery routes and hours. The applicant mould be required to fund the cost of one- <br />half apolice officer's salary for one year to help enfoJ~ce these conditions. The <br />applicant would also be required to hire an on-site monitor to make sure that trucks <br />a~°riving early are turned away. <br />• Identify plan for short-term and permanent code enforcement/ongoing <br />reporting/tracking to ensure that trucks stay on approved routes. <br />As stated, an on-site monitor and monitoring plan with a video cameo°a are required <br />to help ensure compliance ~~~ith the conditions on truck delivery routes and times. As <br />also conditioned, the City's Code Enforcement and/or Police Department staff will <br />work together as necessary to achieve compliance, especially during the i~zitial <br />operation of the center. If this is not successful, the Planning Director can then <br />proceed to the next level of enforcement action involving citations and fines and/or <br />bringing the use permit back to the Planning Commission to consider adding or <br />modifying the conditions of approval. Staff has also suggested a 6-month review of <br />the operation to ensure compliance. <br />• Consider proposal for an ordinance to increase fines for violations to conditions. <br />Staff l~~ill propose modifying the City's Master Fee Resolution to increase citations <br />from the current $750 up to $1, 000. <br />• Check with other cities for ways to protect the community. <br />See above. <br />• Identify process for review/modificatioi~/revocation of conditional use permit if <br />necessary due to ongoing violations. <br />12 <br />
