Section 21. Promotion <br /> <br /> Promotional or open-promotional examinations may be conducted <br /> whenever in the opinion of the Personnel Officer the needs of <br /> the service require. Only employees who meet the requirements <br /> set forth in the examination announcements may compete in <br /> promotional examinations. <br /> <br /> Insofar as consistent with the best interests o[~ the service <br /> all vacancies in the competitive service shall be filled by <br /> promotion from within the competitive service after a <br /> promotional examination has been given and a promotional list <br /> established. <br /> <br /> When the needs of the service so require, an employee meeting <br /> the minimum qualifications may be temporarily promoted to an <br /> authorized position on an "acting" basis. While serving in the <br /> position the employee temporarily promoted shall be paid the <br /> minimum rate of pay for the classification except that said <br /> rate of pay shall be no less than 5% above the employee's <br /> normal rate of pay. <br /> <br /> Nothing in this section, however, shall restrict a Department <br /> Head from requiring an employee possessing the minimum <br /> qualifications to serve in a higher classification without an <br /> adjustment in compensation for a period not to exceed five (5) <br /> consecutive working days. <br /> <br /> If, in the opinion of the Personnel Officer, a vacancy in the <br /> position could be filled better by an open-competitive <br /> examination instead of promotional examination, he/she shall <br /> arrange an open-competitive employee list consistent with the <br /> Personnel Rules. <br /> <br />Section 22. Transfer <br /> <br /> An employee may be transferred by the Appointing Authority to a <br /> comparable position. For purposes of this section a comparable <br /> position is one with the same maximum salary, involving the <br /> performance of similar duties and requiring substantially the <br /> same minimum qualifications. <br /> <br /> If the transfer involves a change from one department to <br /> another both Department Heads must consent thereto unless the <br /> City Manager orders the transfer for purposes of economy and <br /> efficiency. Transfer shall not be used to effect discipline or <br /> a promotion or advancement. <br /> <br />Section 23. Resignation, Reinstatement and Layoff <br /> <br />23.1 Automatic Resignation <br /> <br /> Failure to return at the expiration of a leave of absence or <br /> being absent without leave shall be considered an automatic <br /> resignation. Such a resignation may be rescinded by the City <br /> Manager if the employee submits satisfactory reasons for <br /> <br /> - 28 - <br /> <br /> <br />
