<br />CONTRACT <br />WEST LAS POSITAS MEDIAN LANDSCAPING, PHASE 1 <br />THIS CONTRACT is made and entered into this 5th day of December, 2007 by <br />and between Planned Environments, Inc., ("Contractor"), whose address is 2440 Stanwell <br />Drive, Suite B, Concord, CA 94520, and telephone number is (925) 957-1792 and the <br />CITY OF PLEASANTON, a municipal corporation ("City"). <br />WITNESSETH: <br />WHEREAS, the City has awarded to the Contractor a contract for WEST LAS <br />POSITAS MEDIAN LANDSCAPING, PHASE 1. <br />NOW, THEREFORE, in consideration of the mutual promises set forth herein, <br />the parties agree as follows: <br />Work to be Performed. The project consists of the complete renovation of nine (9) <br />roadway median islands on West Las Positas Boulevard, from Santa Rita Road to <br />Thistledown Court. <br />Said work is more particularly shown in the following documents which are on <br />file with the Department of Public Works of the City and are incorporated herein <br />by this reference: <br />A. Plans and Specifications entitled the WEST LAS POSITAS <br />MEDIAN LANDSCAPING, PHASE 1 and addenda thereto, if <br />any. <br />B. Contract Change Orders approved by the City Engineer, done in <br />accordance with the Standard Specifications. <br />C. The proposal submitted to the City by the Contractor. <br />2. Compensation. The City shall pay the Contractor for work actually performed at <br />the unit prices set out in the Contractor's proposal to the City. The quantities of <br />work stated therein are estimates only; actual quantities will be measured for <br />payment in accordance with the specifications. <br />
