CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 87-224 <br /> <br /> RESOLUTION DENYING THE APPEAL OF THE <br /> CITY COUNCIL AND APPROVING THE <br /> CONDITIONAL USE PERMIT FOR THE GAME <br /> STATION AT 4301 FOR NINETY (90) DAYS <br /> <br />WHEREAS, the original use permit_ for the Game Station <br /> expired March, 1987 and the owner, Larry Evans <br /> applied to the Planning Commission for a new use <br /> permit; and <br /> <br />WHEREAS, at its meeting of April 22, 1987, the Planning <br /> Commission above Case UP-87-6 subject to certain <br /> conditions; and <br /> <br />WHEREAS, this decision was appealed by the City Council so <br /> that they could review the application more fully; <br /> and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on May 19, 1987 at which time the applicant and any <br /> other member of the public was offered an <br /> opportunity to present evidence regarding this <br /> appeal; <br /> <br />WHEREAS, the City Council makes the following findings with <br /> regard to the application: <br /> <br /> a. That the proposed location of the conditional <br /> use is in accordance with the objectives of <br /> the zoning ordinance and the purposes of the <br /> district in which the site is located. <br /> <br /> b. That the proposed location of the conditional <br /> use and the conditions under which it would be <br /> operated or maintained will not be detrimental <br /> to the public health, safety, or welfare, or <br /> materially injurious to the properties or <br /> improvements in the vicinity. <br /> <br /> c. That the proposed conditional use will comply <br /> with each of the applicable provisions of <br /> Chapter 18.124 of the Pleasanton Municipal <br /> Code regarding conditional uses. <br /> <br /> <br />
