K999-050 <br />04.28.87 <br />realestl-1846 <br /> <br />through __, for the purpose of public recreational use. <br />Bernal and City agree that "public recreational use" shall <br />include jogging, walking, hiking, bicycling, nature study, <br />viewing scenic or natural sites, par-course activities, if <br />applicable, and access for emergency vehicles, and shall <br />exclude activities prohibited by City's Regulations of <br /> <br />Recreational Facilities (Title IV, Chapter 13.08, P.M.C.) <br /> <br />("Recreation Ordinance"), as hereafter amended or <br />supplemented. The plans for improvement of the Recreation <br /> <br />Easement shall include signs restricting use of the Recreation <br /> <br />Easement in accordance with the Recreation Ordinance. City <br /> <br />shall be responsible for making future changes to such signs <br />when changes are required by changes in the Recreation <br />Ordinance. Bernal and City agree that public recreational use <br />shall be permitted only during daylight hours, unless City <br />installs lighting in such Recreation Easement at City's <br />expense. Further, Bernal and City agree that the Recreation <br />Easement shall not be subject to reservation for usage by large <br />groups. <br /> <br /> In the event Bernal, City or Association determines <br />that any public use made of the Recreation Easement not <br />specifically addressed in this Agreement is inappropriate or <br />undesirable, said party shall notify the others in writing of <br />the inappropriate or undesirable use being made of the <br />Recreation Easement, and the parties shall thereafter meet to <br /> <br /> -3- <br /> <br /> <br />
