RESOLUTION NO. <br /> <br /> SUPPORTING THE USE OF AMERICAN RIVER WATER TO PRESERVE A HIGH <br /> QUALITY WATER SUPPLY <br /> <br /> Introduced by, ; seconded by <br /> <br /> WHEREAS the East Bay Municipal Utility District (EBMUD) <br />signed a contract with the Bureau of Reclamation in 1970 for <br />delivery of 150,000 acre feet of water annually from the American <br />River; and <br /> <br /> WHEREAS a lawsuit was filed in court fifteen years ago <br />seeking to prevent EBMUD from diverting water from the American <br />River at the Folsom South Canal; and <br /> <br /> WHEREAS the court appointed the State Water Resources <br />Control Board (SWRCB) as its referee and a February 1987 Draft <br />Referee report made the following findings: <br /> <br /> * American River water would provide the best water quality <br /> and pose the least public health risk than any other <br /> alternative. <br /> * There is no alternative clearly superior to EBMUD's <br /> proposal. <br /> * EBMUD has a need for additional high quality water to meet <br /> future demand. <br /> * Water rights contracts for municipal water should not be <br /> modified or set aside without good cause and EBMUD's <br /> proposed use of the American River water is reasonable. <br /> * That even with conservation measures studies have determined <br /> that a need exists for additional water to serve more than <br /> one million customers in Alameda and Contra Costa counties <br /> to offset deficiencies during drought years and to meet <br /> future demands. <br /> <br /> WHEREAS, the report contains new guarantees that assure <br />the benefits now enjoyed by residents of Sacramento are not <br />diminished; and <br /> <br /> WHEREAS, the Board staff report demonstrated confidence <br />in the ability of the District to properly manage its water <br />resources in an efficient and environmentally sound manner; <br /> <br /> NOW THEREFORE BE IT RESOLVED that this Board urges the <br />State Water Resources Control Board to adopt its staff report <br />which supports the proposal by EBMUD to make prudent use of the <br />water from the American River thereby ensuring an adequate and <br />high quality source of drinking water for its customers. <br /> <br />P87.63 <br /> <br /> <br />
