Further, no evidence was pre- <br /> sented demonstrating that any other alternative is more feasible than <br /> proposed diversion via the Folsom-South Canal. Finally, due to the limitations <br /> of this case, there is no certainty that the water EBMU~ could be prohibited <br /> from taking would remain available for use in the lower American River. <br /> <br />The results of the investigation conducted by the Board 's staff are presented <br />in the Draft Report and supplemental reports on legal and technical issues. <br />These draft reports have been distributed to the parties tD the lawsuit, wh~ <br />will have an opportunity to submit objections. The State Board will hold a <br />hearing on the objections to the draft report. The hearing is tentatively <br />scheduled to begin on May 27, 19~7. In addition, a hearing will be sched~l=_~ <br />to receive public comment on the draft report. <br /> <br />This Executive Summary consists of three sections: <br /> <br /> · Background This section provides background information relating t3 <br /> the lawsuit and describes the Board's procedures. <br /> <br /> · Findings of Fact This section provides a sun~ary of the Boar~'s <br /> conclusions on the major technical and public trust issues. <br /> <br /> · Recommendations This section describes the Board's recommended <br /> <br /> solution and the rationale supporting that recommendation. <br /> <br /> <br />
