WHEREAS, access to the roads in Ruby Hill is restricted at entrance gates, <br />maintained by the Ruby Hill Homeowners' Association; and <br />WHEREAS, regular vehicular traffic and golf carts, as defined by section 345 of <br />the California Vehicle Code, are operated on the roads in Ruby Hill; and <br />WHEREAS, the City of Pleasanton has received from the Board of Directors of <br />the Ruby Hill Homeowners' Association a petition, adopted by the Board on July 10, <br />2006, that requests that the Pleasanton Police Department enforce the California <br />Vehicle Code on roads in Ruby Hill; and <br />WHEREAS, by reason of the roads' proximity to or connection with public <br />highways, the interests of the residents residing along the roads and the motoring public <br />shall best be served by the application of the provisions of the California Vehicle Code <br />to those roads; and <br />WHEREAS, notice to consider this issue has been provided to the Ruby Hill <br />Homeowners' Association and property owners in Ruby Hill at least ten days prior to <br />this hearing. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br />THE FOLLOWING: <br />SECTION 1. The roads in Ruby Hill are privately owned and maintained by the <br />Ruby Hill Homeowners' Association and constitute private roads, as defined by section <br />490 of the California Vehicle Code. <br />SECTION 2. The roads in Ruby Hill are not generally open for use of the public <br />for purposes of vehicular travel but, by reason of their proximity to or connection with <br />highways, the interests and safety of motorists, pedestrians, and residents residing <br />along the roads and the protection of property shall best be served by application of the <br />California Vehicle Code to those roads. <br />SECTION 3. The conditions of California Vehicle Code section 21107.7 have <br />been satisfied. <br />SECTION 4. The roads in Ruby Hill provide access to the Ruby Hill Golf Club <br />and are hereby designated for combined use by golf carts, as defined by section 345 of <br />the California Vehicle Code, and regular vehicular traffic. <br />SECTION 5. Golf carts, driven on the roads in Ruby Hill, must be operated in <br />compliance with the California Vehicle Code, with the exception of registration, <br />licensing, and equipment requirements of the Califomia Vehicle Code, unless operated <br />during darkness during which golf cars shall be subject to section 24001.5 of the <br />California Vehicle Code regarding equipment. <br />SECTION 6. The City of Pleasanton shall establish speed limits, yield <br />intersections, stop intersections, and parking for emergency vehicles on the roads in <br />
