Noise <br />1. Construction period: effect of the project on the setting (pp. 206 208, 208-209 <br />and 370-372; Condition 19-20 of PUD-33; MMIP J1). <br />a. Potentiallmgact. <br />Development of the Environmentally Superior Project could temporarily increase noise <br />levels and could be annoying at times. <br />b. Mitigation Measures. <br />The following mitigation measure is hereby adopted and will be implemented as <br />provided for in the Mitigation Monitoring and Implementation Program: <br />Implement Oak Grove Planned Unit Development (PUD-33) Mitigation <br />Measure J1. <br />c. Findings. <br />Based on the EIR and the entire record before the City, the City finds that: <br />(i) Effects of Mitigation. <br />The Environmentally Superior Project's potential impacts due to construction noise will <br />be mitigated to less-than-significant levels through the implementation of the mitigation <br />measures discussed above because the measure requires the PUD Development Plan <br />conditions to incorporate noise reduction requirements, including limits on the hours of <br />construction activity and best management practices for construction noise. Further, the <br />Environmentally Superior Project includes, as conditioned, contains requirements that <br />the project developer and/or future building developers shall complete the specific <br />actions: <br />• All subdivision improvements and site improvements and house construction <br />activities shall be limited to the hours of 8:00 a.m. to 5:00 p.m., Monday through <br />Friday. The Planning Director may authorize on a case-by-case basis alternate <br />construction hours for specific activities including concrete work, asphalt work, <br />etc. <br />To mitigate construction impacts to the surrounding properties adjoining the north <br />and west sides of the Oak Grove property, the project developer shall prepare a <br />Construction Best Management Plan (CBMP) for the review and approval by the <br />City before the City's action on the first Final Subdivision Map. The CBMP shall <br />include, but is not limited, limits on equipment noise levels, equipment equipped <br />with intake/exhaust mufflers, locations for stationary noise generating equipment, <br />"quiet" air compressors and other stationery noise sources, radios, etc. <br />Exhibit A Page 37 of 45 Ordinance No. 196 i <br />PUD-33, Oak Grove <br />
