RUBY HILL OWNERS' ASSOCIATION <br />TRAFFIC PETITION HISTORY <br />California Vehicle code 21107.7 allows a majority either of the homeowners or a majority of the Board of <br />Directors of a common interest development to petition the City requesting an enforcement change in a private <br />development. <br />In Apri12000 and December 2002, the Ruby Hill Owners' Association Board of Directors agreed to place this <br />issue on a ballot for the homeowners of the development to vote on. The results of each ballot were very close, <br />approximately 51% against and 49% in favor, of petitioning the City for traffic enforcement. <br />Due to the rapid growth of the community, the total number of homes and drivers has grown substantially <br />since the homeowners were surveyed. With this in mind, the number of young, less experienced drivers, <br />within the community has significantly increased, along with the number of accidents both multi and single <br />car. <br />The Ruby Hill Owners' Association Articles of Incorporation (Article II -Purposes of the Association) states in <br />part that it's specific and primary purposes are to provide for the management and administration, as well as <br />to promote the health, safety, and welfare of all residents within the project. <br />The Board has the responsibility to do everything possible to ensure that all homeowners are provided equal <br />traffic service/support, with regard to personal safety, as the rest of the Pleasanton community. <br />Given these facts, the Board of Directors notified the Ruby Hill homeowners they would be putting this safety <br />matter to vote in July 2006. Many residents attended this Board meeting to state their concerns both for and <br />against this potential change. After much discussion, the Board voted unanimously in favor of petitioning the <br />City Council to allow for traffic enforcement in the Ruby Hill community. <br />The Ruby Hill HOA has paid for and provided a traffic study to the City along with the consulting firm's <br />observations and recommendations.
