Councilmember Sullivan questioned and confirmed with City Attorney Roush that all parks <br />voted on the agreement, that the proposal was presented to the residents last week for the <br />vote so it was not included as part of the presentation. He confirmed Ms. Perkins was not <br />reconsidering her vote, but residents of the park were not happy with the paragraph, they <br />voted reluctantly on it but agreed to the compromise. <br />Jackie Hawk thanked the Council and City Attorney Roush on behalf of their park. <br />Councilmember McGovern referred to page 5, paragraph "d", of the Vineyard Mobilehome <br />Park and asked that the cost of living be changed to what we know it is, at 2.6%. City <br />Attorney Roush said the amount was presented as an example, but for 2008 it will be <br />2.6% and said the percentage would be changed. <br />Mayor & City Council <br />3. Pulled and rescheduled to November 6, 2007 -Second reading of Ordinance No. 1961 <br />approving the application of James Tong, Charter Properties (Oak Grove Development), <br />for PUD Development Plan approval, as filed under Case PUD 33 <br />Mary Roberts referred to the EIR which was listed as part of the PUD and asked if there <br />needed to be some sort of documentation that would require signature, such as a <br />resolution. <br />City Attorney Roush said the resolution certifying the EIR was adopted at the last Council <br />meeting and until the PUD plan and development agreement themselves are approved by <br />the Council, the Notice of Determination is not filed with the County or the State until such <br />time those actions are approved. He said even though the EIR has been certified, no <br />further action is required on the Council's part. Filing the Notice of Determination occurs <br />after second reading of the ordinances. <br />7. Pulled and rescheduled to November 6, 2007 -Second reading of Ordinance No. 1962 <br />approving a Development Agreement between the City Of Pleasanton and Jennifer Lin <br />and Frederic Lin regarding the Oak Grove Development <br />Public Works <br />8. Accepted public improvements performed by McGuire and Hester for the Santos Ranch <br />Road Pump Stations and Water Facilities Upgrade, CIP No. 991035; authorized filing a <br />notice of completion; payment of retention is the amount of $102,820.66 and final payment <br />in the amount $1,424.53 <br />City Council Minutes 2 October 16, 2007 <br />
