Councilmember Sullivan questioned and confirmed with City Attorney Roush that all parks voted on the agreement, that the proposal was presented to the residents last week for the vote so it was not included as part of the presentation. He confirmed Ms. Perkins was not reconsidering her vote, but residents of the park were not happy with the paragraph, they voted reluctantly on it but agreed to the compromise. Jackie Hawk thanked the Council and City Attorney Roush on behalf of their park. Councilmember McGovern referred to page 5, paragraph "d", of the Vineyard Mobilehome Park and asked that the cost of living be changed to what we know it is, at 2.6%. City Attorney Roush said the amount was presented as an example, but for 2008 it will be 2.6% and said the percentage would be changed. Mayor & City Council 3. Pulled and rescheduled to November 6, 2007 -Second reading of Ordinance No. 1961 approving the application of James Tong, Charter Properties (Oak Grove Development), for PUD Development Plan approval, as filed under Case PUD 33 Mary Roberts referred to the EIR which was listed as part of the PUD and asked if there needed to be some sort of documentation that would require signature, such as a resolution. City Attorney Roush said the resolution certifying the EIR was adopted at the last Council meeting and until the PUD plan and development agreement themselves are approved by the Council, the Notice of Determination is not filed with the County or the State until such time those actions are approved. He said even though the EIR has been certified, no further action is required on the Council's part. Filing the Notice of Determination occurs after second reading of the ordinances. 7. Pulled and rescheduled to November 6, 2007 -Second reading of Ordinance No. 1962 approving a Development Agreement between the City Of Pleasanton and Jennifer Lin and Frederic Lin regarding the Oak Grove Development Public Works 8.
