' and that construction of industrial/commercial complexes <br />takes place in an orderly manner. In order to allow Delta <br />time to perfect plans and studies of the proposed development <br />of Lots 11 and 12 of Tract 4788 and to provide for the <br />orderly development of the Pleasanton Park Business <br />Center, the parties have reached agreement concerning the <br />issuance of building permits for buildings to be located on <br />Lots 11 and 12 and now desire to set forth their mutual <br />understanding and agreer.-=.ent pertaining thereto in writing. <br />DEL`T'A and CITY, in consideration of the above, agree <br />as follows: <br />1. No building per~rits will be issued on the portions <br />of Tract 4788 designated as Lots 11 and 12 for a period of <br />one (1) year from the date of this agreement. Nothing herein <br />shall preclude Delta, its successors and assigns, fron <br />submitting plans and development proposals for said lots, <br />including, but not limited to, the submission of a proposal <br />for further subdivision of said lots, revisions to Tract <br />4788 or building permit applications .during the period <br />in which the issuance of building permits is forbidden by <br />this agreement or at any other tirn.e. <br />2. It is mutually understood that the effect of this <br />agreement is to extend until September 23, 1983, the time <br />within which building permits can be obtained for the portion <br />of Tract 4783 now designated as Lots 11 and 12 by Delta, <br />-3- <br /> <br />
